010 <br />Legislative Bill Action <br />................................ ............................... <br />PUBLIC SAFETY <br />AB 27 (Parra). Sex Offender Registration. AD <br />27 provides for the elimination of the sunset on sex <br />offender registration statutes related to the respon- <br />sibilities of local law enforcement to provide a CD- <br />ROM that details any registered sex offenders <br />residing in the requester's zip code (Penal Code <br />290.4). The statute outlines the responsibilities of <br />the Department of Justice (DOJ) as it relates to <br />database compilation and maintenance. AB 27 also <br />states the intent of the Legislature to consider <br />posting sex offender information on the Internet <br />should the Supreme Court uphold laws permitting <br />such posting. Police Vehicle Pursuits. e@ <br />74 makes the act of willfully evading a peace officer <br />while operating a motor vehicle a felony (as op- <br />posed to a misdemeanor), and increases the <br />minimum fine from $1000 to $2000. AS 74 also <br />provides that causing bodily injury or property <br />damage during such an evasion is subject to a one - <br />year prison sentence enhancement. AB 486 increases the penalties for <br />driving with a suspended license for a person <br />previously convicted of reckless driving, driving <br />under the influence, or denied a driver's license <br />due to negligence. Specifically, AB 486 amends <br />Vehicle Code section 14601 to increase <br />punishments for a previous conviction of reckless <br />driving or reckless driving with an injury; previous <br />refusal of a driver's license by the Department of <br />Motor Vehicles (DMV) following a determination that <br />an individual is incapable of driving safely due to <br />chronic alcoholism; previous refusal of a driver's <br />license by the DMV following a determination that <br />an individual is incapable of driving safely due to a <br />physical disorder accompanied by recurrent lapses <br />of consciousness; or refusal of a driver's license by <br />the DMV following a determination that the <br />individual is a negligent or incompetent operator of <br />a motor vehicle. AB 136 passed <br />out of the Assembly Insurance Committee on <br />Wednesday, April 2, 2003 on a party line vote, with <br />one Republican voting AYE. Approximately twenty <br />city and county representatives testified in opposi- <br />tion. Unfortunately, the bill has now been sent to the <br />Assembly Appropriations Committee and will be <br />heard in the coming weeks. This bill would extend <br />temporary disability (Labor Code 4850) for safety <br />officers to two years. This bill would have dramati- <br />cally adverse effects on our local agency budgets in <br />a time where layoffs, local service cutbacks and an <br />enormous state budget deficit is a part of our reality. <br />Under current law, firefighters and police officers are <br />entitled to up to one year of temporary disability <br />time off while receiving tax -free payments of their full <br />salary. Because the benefit is full salary, but tax <br />free, the amount received by the injured officer <br />significantly exceeds their normal take -home com- <br />pensation. A temporarily injured safety employee <br />under this law cannot retire until their "4850" time is <br />exhausted. The local agency cannot permanently fill <br />that position until the injured worker returns to <br />modified work or retires. One missing employee <br />severely hampers response models and emergency <br />operations so overtime personnel are hired back to <br />sustain staffing levels. Typically, a local agency <br />backfills positions for the entire year, which in- <br />creases costs extensively (full salary for the injured <br />officer; time and a half for the replacement who is <br />out on "4850" time). This occurs even when the <br />agency is aware that the injured worker will eventu- <br />ally retire on disability. Because of the law, the <br />agency cannot retire the injured worker without his <br />or her consent, prior to the exhaustion of the 4850 <br />benefits unless their injury is determined to be <br />"permanent and stationary" as found by the Work- <br />ers' Compensation Appeals Board.
