(a) The fees distributed to the City /County Association <br />of Governments of San Mateo County pursuant to Section 9250.16 of <br />the Vehicle Code shall be used for purposes of congestion management <br />and storm water pollution prevention as specified in its adopted <br />congestion management program, pursuant to Section 65089, and its <br />approved National Pollutant Discharge Elimination System permit <br />issued pursuant to the federal Clean Water Act (33 U.S.C. Sec. 1251 <br />et seq.). <br />(b) Not more than 5 percent of the fees distributed to the <br />City /County Association of Governments of San Mateo County shall be <br />used by the association for its administrative costs associated with <br />the program. <br />65089.13. Prior to the imposition of the fee by the City /County <br />Association of Governments of San Mateo County, a specific program <br />with performance measures and a budget shall first be developed and <br />adopted by the association at a noticed public hearing. <br />SEC. 2. Section 9250.5 is added to the Vehicle Code, to read: <br />9250.5. (a) The department shall, if requested by the City /County <br />Association of Governments of San Mateo County, collect the fee <br />imposed pursuant to Section 65089.11 of the Government Code upon the <br />registration or renewal of registration of any motor vehicle <br />registered in the county, except those vehicles that are expressly <br />exempted under this code from the payment of registration fees. - <br />(b) After deducting all costs incurred pursuant to this section, <br />the department shall distribute the revenues to the City /County <br />Association of Governments of San Mateo County. <br />(c) The department may annually expend for its administrative <br />costs not more than the following percentages of the fees collected <br />pursuant to subdivision (a): <br />(1) During the first year after the fee is imposed, 5 percent. <br />(2) During the second year after the fee is imposed, 3 percent. <br />(3) During any subsequent year, 1 percent. <br />Page 2 of 2 <br />httn• //info gensa amt /nnh/hill /asm /ah 1501- 1550/ah 1546 hill 1 -0010221 introduced html V76/2001 <br />
