REPORT <br />To the Honorable Mayor and City Council <br />From the City Clerk <br />7.1F1 <br />April 28, 2003 <br />Subject <br />Award of Bid for Annual Legal Advertising for Redwood City <br />Recommendation <br />Motion to award bid to the Redwood City Daily News for annual legal publishing services in <br />the amount of $8.95 per column inch for the calendar year 2003. <br />Background <br />As directed by the Redwood City Charter, advertisement for bids from all newspapers of <br />general circulation occurred and bids were opened on December 27, 2002. The City <br />Charter provides for advertisement for the submission of sealed proposals or bids from all <br />newspapers of general circulation in the city. Bids were submitted by two newspapers: The <br />Redwood City Tribune /Independent (Independent) at $8.98 per column inch; and the <br />Redwood City Daily News (Daily News) at $8.95 per column inch. <br />On January 13, 2003, the City Council considered this topic and voted unanimously to <br />table the item and direct the City Attorney to investigate whether awarding of the bid could <br />be based upon specifications not included in the bid package. <br />On or about March 6, 2003, the City Attorney's Office distributed a memorandum to the <br />City Council in which it was concluded that '... ra for to award of a bid for publication of <br />legal ads, specifications may be included in a bid invitation. ' However, in this instance, <br />the bids having already been opened, no further opportunity for supplementing the bid <br />instructions is possible. <br />The above - referenced Charter requirement for annually seeking bids for the publication <br />of legal notices has been a persistent concern of City Councils. Council may wish to <br />take this opportunity to direct the City Attorney to recommend a ballot measure for the <br />2003 General Municipal election which would address this requirement. <br />Fiscal Impact <br />Funds for legal advertising are budgeted in the amount of $15,000.00 for Fiscal Years <br />2002/03 and 2003/04. <br />4 atricia S.
