release of any or all of the security given for the payment of this Note or the release of any party <br />liable for this obligation. <br /> <br /> Lawful Interest Rate: All agreements herein are expressly limited so that in no <br />contingency or event whatsoever, whether by reason of advancement of the proceeds of this <br />Note, acceleration of maturity of the unpaid principal balance thereof, or otherwise, shall the <br />mount paid or agreed to be paid to Lender for the use, forbearance or detention of the money to <br />be advanced under this Note exceed the highest lawful rate permissible under applicable usury <br />laws. If, from any circumstances whatsoever, the fulfillment of any provision hereof or of this <br />Note or any other documents at the time performance of such provision shall be due, shall <br />involve transcending the limit of validity prescribed by law which a court of competent <br />jurisdiction may deem applicable hereto, then, ipso facto, the obligation to be fulfilled shall be <br />reduced to the limit of such validity; and if, from any circumstance holder shall ever receive as <br />interest an amount which would exceed the highest lawful rate, such amount which would be <br />excessive interest shall be applied to the reduction of the unpaid principal balance due on this <br />Note and not to the payment of interest. <br /> <br /> Security: This Note is secured by a Deed of Trust of even date herewith encumbering the <br />Property, naming OLD REPUBLIC TITLE COMPANY, as Trustee, executed by Borrower in <br />favor of Lender, and is given as part of the purchase price for the Property. <br /> <br /> Notice of Balloon Payment: This Note is subject to Civil Code Section 2966, which <br />provides that the holder of this Note shall give written notice to Borrower, or the Borrower's <br />successor in interest, of prescribed information at least 90 days and no more than 150 days <br />before any balloon payment is due. <br /> <br /> Construction of Document: This Note shall be governed and construed in accordance <br />with the laws of the State of California. <br /> <br /> Dated: August 14, 2003 <br /> <br /> BORROWER: <br /> <br /> Stan Yamamott( <br /> Y&mamoto ~ 0'a'r~"Z~l~ <br /> <br /> <br />
