NONDISCRIMINATION. In performing services hereunder, Auditor shall <br />comply with Title VI of the Civil Right Act of 1964, as amended. Accordingly, reference <br />is hereby made to 49 Code of Federal Regulations ("CFR") 21 through Appendix H and <br />23 CFR 710.405 (b), and the California Fair Employment and Housing Act (Part 2.8 <br />[commencing with §12900 et seq.] of Div, 3 of Title 2), and the provisions of Section 504 <br />of the Rehabilitation Act of 1973, as amended, and the American with Disabilities Act of <br />1990, providing equal access and reasonable accommodations in employment <br />programs and services to qualified persons who are disabled, which provisions <br />hereinabove specified are hereby incorporated herein by this reference. <br /> <br /> 16. ATTORNEY'S FEES. If any legal proceedings are instituted by either of the <br />parties hereto to enforce the terms of this Agreement or to determine the rights of the <br />parties hereunder, the prevailing party shall recover, in addition to court costs, <br />reasonable attorneys' fees. <br /> <br /> 17.
