<br />AB 50 (Koretz). .50 BMG Rifle. AS 50
<br />would add the .50 caliber BMG rifle to the list of
<br />dangerous weapons, and create new felonies for
<br />the manufacture, sale, or possession without a
<br />permit of this firearm. This bill is supported by the
<br />California Organization of Police and Sheriffs
<br />(COPS), City of Los Angeles, Community
<br />Wellness Partnership, Los Angeles County
<br />Sheriffs Department, California Chapter of the
<br />American College of Emergency Physicians. AB
<br />50 was heard in the Assembly Public Safety
<br />Committee on April 29, 2003, due pass as
<br />amended. The League is currently taking a
<br />WATCH position on this bill to track amendments.

<br />AB 140 (Levine). Vehicles: Peace Officers.
<br />Fleeing. As amended April 29, AB 140 increases
<br />penalties for intentionally attempting to evade a
<br />peace officer and causing either serious bodily
<br />injury or death of another person. Specifically, AB
<br />140 provides that a person who attempts to
<br />willfully evade a peace officer with disregard for
<br />public safety will be punished exclusively with a
<br />felony and imprisonment in state prison for one,
<br />two or three years and may also face a fine of
<br />between $1,000 and $10,000. The bill adds
<br />several other penalty levels for other circum-
<br />stances when someone flees a police officer. AB
<br />140 passed out of committee on April 29, 2003,
<br />and was referred to Assembly Appropriations.

<br />AB 1050 (Pacheco). Police Vehicle Pur-
<br />suits. Punishment Specifically, AB 1050
<br />increases the penalty for attempting to evade a
<br />peace officer resulting in serious bodily injury to
<br />another, from an alternate felony /misdemeanor
<br />punishable by one year in county jail or three, four
<br />or five years in state prison, to a felony punishable
<br />by five, seven or nine years in state prison and a
<br />fine between $2,000 to $10,000. AB 1050 also
<br />increases other penalties in these circumstances.
<br />AB 1153 (Bermudez). Crime. As amended
<br />April 21, existing law provides that a person who
<br />willfully makes or sells any badge which falsely
<br />purports to be authorized for the use of a peace
<br />officer, or which so resembles the authorized
<br />badge of a peace officer is guilty of a misde-
<br />meanor punishable by imprisonment in a county
<br />jail for a period not exceeding one year, a fine not
<br />exceeding $15,000, or both imprisonment and
<br />fine. The measure provides additional penalties
<br />under these circumstances. Staff: Natasha

<br />SB 58 (Johnson). Police Reports. As
<br />amended April 22, SB 58 would provide that a
<br />police report, arrest report, or investigative report,
<br />and any Rem attached to It submitted to a court by
<br />a prosecutor or law enforcement officer, be sealed
<br />by the court. SB 58 would permit these records to
<br />be inspected, upon request, after the court pre-
<br />pares and provides a copy of the report from
<br />which all personal identifying information has been
<br />redacted regarding any witness or victim. SB 58 is
<br />designed to safeguard the privacy of personal
<br />information about victims and witnesses named in
<br />police reports that are filed with the courts. This
<br />bill is supported by the California Peace Officers'
<br />Association, California State Sheriffs' Association
<br />and California District Attorneys Association.

<br />HUMAN RESOURCES
<br />AB 359 (Koretz). Public Safety Officers.
<br />Off Duty Employment AB 359 prohibits cities
<br />and counties from enforcing off-duty employment
<br />regulations upon public safety officers. The issue
<br />of posing limits on outside employment for local
<br />safety personnel is one of a local matter that
<br />should be negotiated during the meet and confer
