To Al <br />May 19, 2003 <br />Subject <br />Relinquish Interest in a Parcel of Land to Caltrans for the Construction of the Ralston <br />Avenue Interchange Project <br />Recommendation <br />Approve and authorize the City Manager to execute a Quit Claim Deed, relinquishing to <br />the State, any interest that the City may have on a parcel of land adjacent to the <br />Ralston Avenue Interchange Project, for the improvement of the interchange. <br />Background <br />The Ralston Avenue Interchange is a project within the Caltrans right -of -way, which the <br />City is pursuing (with some help from the City of Belmont). This project is partially <br />funded by grants from the State and Federal government. The grants have strict <br />deadlines, and authorities have been diligent in enforcing these deadlines given the <br />shortfall in the budgets. Deadlines and Caltrans bureaucracy do not coexist very well; <br />therefore, staff have been pushing hard to get things done. This issue only recently <br />surfaced, and needs to be reconciled as soon as possible. <br />Caltrans and the title company are not certain as to the ownership of the parcel. <br />Documents exist which show the parcel is owned by the State, but Caltrans' surveyor <br />insisted that the parcel was relinquished to the City at some point in time. Research can <br />and will be done to determine the actual ownership; however, in the interest of time, <br />Caltrans has requested we provide them with this quit claim deed (see attached). If the <br />State already has title to the parcel, the deed will be null and void. If the City actually <br />owns the parcel, it would go to proper use as part of the freeway interchange, a project <br />which will benefit the City and its citizens. <br />The parcel is located at the intersection of Oracle Parkway (West) along Marine <br />Parkway. It consists of about 1,400 square feet. Government Code Section 37351 <br />gives the City Council the authority to control, dispose of, and convey such property for <br />the benefit of the City. <br />Alternative <br />Do not execute this Quit Claim Deed, which will put the State and Federal Grants in the <br />amount of $7.6 million for the Ralston Avenue Interchange Project in jeopardy. <br />Page 1 of 2 <br />
