Staff: <br />Natasha Fooman, Status: AsmFlr, Position: Sup- <br />port. <br />SB 58 (Johnson). Police Reports. (Amended 4 <br />30-02) SB 58 would provide that a police report, <br />arrest report, or investigative report, and any item <br />attached to it, submitted to a court by a prosecutor or <br />law enforcement officer, be kept confidential by the <br />court. SB 58 would permit these records to be <br />inspected, upon request, after the court prepares and <br />provides a copy of the report from which all personal <br />identifying information has been redacted regarding <br />any witness or victim. SB 58 is designed to safeguard <br />the privacy of personal information about victims and <br />witnesses named in police reports that are filed with <br />the courts. This bill is supported by the California <br />Peace Officers' Association, California State Sheriffs' <br />Association and California District Attorneys Associa- <br />tion. (Amended 421 -03) Under existing law, a <br />public agency employing peace officers that adopts a <br />written policy on vehicular pursuits complying with <br />specific standards is immune from liability for civil <br />damages for personal injury to, or the death of, any <br />person or damage to property resulting from the <br />collision of a vehicle being operated by an actual or <br />suspected violator of the law who is being, has been, <br />or believes he or she is, or has been, pursued by a <br />peace officer employed by the public entity in a motor <br />vehicle. SB 219 would provide that in a civil action for <br />damages other than by the driver, or his or her <br />accomplices, the civil immunity would only apply if a <br />finding is made that the involved peace officer was <br />complying with the public agency's adopted and <br />implemented written policy on vehicular pursuits. S@ <br />would provide that the finding is a question of fact <br />for the trier of fact. SB 219 would also provide that <br />nothing contained in these provisions affects the <br />application of civil immunity provided to public employ- <br />ees under a related provision of existing law. Staff: <br />Natasha Fooman, Status: SenApps, Position: <br />Oppose. <br />HUMAN RESOURCES <br />AB 1156 (Nunez) Meyers- Milias -Brown Act. Local <br />Public Agencies. This bill revises the definition of <br />"employee organization" for the purposes of the act to <br />include any organization that seeks to represent <br />employees of a public agency. The Meyers- Milias- <br />Brown Act (MMBA) authorizes a local public agency to <br />adopt reasonable rules and regulations after <br />consultation in good faith with representatives of an <br />employer - employee organization or organizations for <br />the administration of employer - employee relations. <br />The bill authorizes a public agency to adopt <br />reasonable rules and regulations after consultation in <br />good faith with representatives of a recognized <br />employer - employee organization or organizations. It <br />specifies that employees of a local public agency and <br />employee organizations may challenge a rule or <br />regulation of a public agency as a violation of the act. <br />The MMBA currently delegates jurisdiction to the <br />Public Employment Relations Board (PERB) to <br />resolve disputes and enforce the statutory duties and <br />rights of local public agency employers and <br />employees, including processing unfair labor charges. <br />The act prohibits the board from finding it an unfair <br />labor practice for an employee organization to violate <br />a rule or regulation adopted by a public agency if that <br />rule or regulation is in violation of the act, based on <br />legislation that was passed in 2000, SB 739. <br />The bill specifies that the powers of the board include <br />the power to order elections, to conduct any election <br />it orders, and to adopt rules to apply in areas where a <br />public agency has no rule. The bill would require that <br />a complaint alleging any violation of any rules and <br />regulations adopted by a public agency regarding the <br />designation of management and confidential <br />employees of a public agency and restricting those <br />employees from representing any employee <br />organization that represents other employees of the <br />public agency be processed as an unfair practice <br />charge and that a complaint raised in the context of a <br />board investigation into unit determination, <br />representation, recognition, or elections be <br />processed as part of that proceeding.
