AGREEMENT <br /> FOR PROFESSIONAL SERVICES <br /> <br /> [WINZLER & KELLY CONSULTING ENGINEERS] <br /> <br /> THIS AGREEMENT, made and entered into this '/'~'~'lday of <br />/, <br />,~i~'Dr~I ,2003, by and between the CITY OF REDWOOD CITY, a charter <br /> <br /> city and municipal corporation of the State of California ("City"), and WlNZLER & <br /> KELLY CONSULTING ENGINEERS ("Consultant") (collectively, the "Parties"). <br /> <br /> WlTNESSETH: <br /> <br /> WHEREAS, City proposes to begin the Bayfront Canal Improvement Project in <br /> the City of Redwood City (the "Project"); and <br /> <br /> WHEREAS, in connection with the Project, the City requires professional <br /> engineering and design services; and <br /> <br /> WHEREAS, Consultant represents that it possesses the experience, and is <br /> qualified to perform the aforesaid services for the Project; <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. CONSULTANT'S SERVICES. Consultant shall perform preliminary design <br /> and related services described in Exhibit "A" hereof, attached hereto and by this <br /> reference incorporated herein. <br /> <br /> 2. COMPENSATION; EXPENSES; PAYMENT. City shall compensate <br /> Consultant for all services performed by Consultant hereunder in an amount based <br /> upon Consultant's hourly rates that are prevailing during the time of the performance of <br /> said services.
