<br />8 <br /> <br />AMENDMENT NO.2 <br />TO AGREEMENT FOR PROFESSIONAL SERVICES <br />(HARRIS & ASSOCIATES) <br /> <br />ORIS /NAL <br /> <br />This Amendment No.2 is entered into and effective as of the~dåy of ~ <br />2003, amending the Agreement dated, February 27,2003 (the "Agreement") by and between the <br />City of Redwood City, a charter city and municipal corporation ("City"), and HARRIS & <br />ASSOCIATES ("Consultant") (collectively, the "Parties") for Professional Construction <br />Management and Administration services related to the Route 1 01/Ralston Avenue Interchange <br />Improvements Project (the "Project"). <br /> <br />RECITALS <br /> <br />A On August 20, 2003, the parties executed Amendment No.1 to the Agreement <br />which authorized the Consultant to perform pre-construction services for the City; and <br /> <br />B. Consultant completed the pre-bid and pre-construction services and is ready to <br />begin construction management, contract administration, and material testing services; and <br /> <br />C. <br />for City; <br /> <br />Section 3 of the Agreement authorizes Consultant to perform additional services <br /> <br />D. The Parties desire to alter the Agreement's scope of work to have the Consultant <br />perform construction management, contract administrative and material testing services; and <br /> <br />E. The Parties have negotiated and agreed to a supplemental scope of work and fee <br />schedule, which is attached to and incorporated by this reference as Exhibit "A," Scope of <br />Services and Fee. <br /> <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, City and Consultant agree as follows: <br /> <br />1. In addition to those services described in the Agreement, as amended, <br />Consultant will provide those services described in the attached Exhibit "A" <br /> <br />2. City will pay Consultant for all work associated with those services described in <br />the attached Exhibit "A," a not-to-exceed amount of One Million Three Hundred Seventy Eight <br />Thousand Seven Hundred Ninety One and No/100 Dollars ($1,378,791.00). Consultant will <br />provide City, on a monthly basis, copies of invoices sufficiently detailed to include hours <br />performed, hourly rates, and related activities and costs for approval by City. <br /> <br />3. <br /> <br />All other provisions of the Agreement, as amended, will remain in full force and <br /> <br />effect. <br /> <br />4. All requisite insurance policies to be maintained by Consultant pursuant to the <br />Agreement, as amended, will include coverage for this Amendment No.2. <br /> <br />Atty/Agr/Harris Amendment 2 <br />111703 <br />
