<br />ORIGINAL <br /> <br />AMENDMENT NO.4 <br />TO AGREEMENT FOR PROFESSIONAL SERVICES <br />(HARRIS & ASSOCIATES) <br /> <br />This Amendment No.4 is entered into and effective as of the March -' 2006, amending <br />the Agreement dated, February 27,2003 (the "Agreement") by and between the City of Redwood <br />City, a charter city and municipal corporation ("City"), and HARRIS & ASSOCIATES <br />("Consultant") (collectively, the "Parties") for Professional Construction Management and <br />Administration services related to the Ralston Avenue/Marine Parkway/Route 101 Interchange <br />Reconfiguration Project (the "Project"). <br /> <br />RECITALS <br /> <br />A On August 20, 2003, the parties executed Amendment No.1 to the Agreement <br />which authorized the Consultant to perform pre-construction services for the City; and <br /> <br />B. On December 8, 2003, the parties executed Amendment No.2 to the Agreement <br />to alter the Agreement's scope of work to have the Consultant perform construction <br />management, contract administrative and material testing services; and <br /> <br />C. On October 12, 2005, the parties executed Amendment No.3 to the Agreement <br />for additional construction management contract administration and material testing. <br /> <br />D. <br />for City; and <br /> <br />Section 3 of the Agreement authorizes Consultant to perform additional services <br /> <br />E. The Parties desire to alter the Agreement's scope of work to have the Consultant <br />perform post construction management services to complete the project; and <br /> <br />F. The Parties have negotiated and agreed to a supplemental scope of work and fee <br />schedule, which is attached to and incorporated by this reference as Exhibit "A," Scope of <br />Services and Fee. <br /> <br />NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, City and Consultant agree as follows: <br /> <br />1. In addition to those services described in the Agreement, as amended, <br />Consultant will provide those services described in the attached Exhibit "A" <br /> <br />2. City will pay Consultant for all work associated with those services described in <br />the attached Exhibit "A," a not-to-exceed amount of Fifty Five Thousand Two Hundred Seventy <br />Two and 72/100 Dollars ($55,272.72). Consultant will provide City, on a monthly basis, copies of <br />invoices sufficiently detailed to include hours performed, hourly rates, and related activities and <br />costs for approval by City. <br /> <br />3. <br /> <br />All other provisions of the Agreement, as amended, will remain in full force and <br /> <br />effect. <br /> <br />Atty/Agr/2005.Harris Amendment 4 <br />091305 <br /> <br />1 <br />
