SB 762 creates a
new crime of possession of a controlled substance
with the intent to commit a sex crime, with the
further purpose of preventing such person from
being admitted to a treatment program under
Proposition 36. According to the author, "Under
current law it is not a crime to possess controlled
substances for sexual predatory purposes. In fact,
unless the perpetrator is apprehended while actually
attempting to drug the victim, he can take shelter
under the treatment provisions of Proposition 36 to
evade accountability. "SB 762 creates a new felony,
punishable by a prison term of three, four, or five
years, and a fine of up to $10,000, for the posses-
sion of a controlled substance with the intent to use
the substance to commit a sex crime.
