<br />SB 762 (Brulte). Nonviolent Drug Posses-
<br />sion Offense. Personal Use. SB 762 creates a
<br />new crime of possession of a controlled substance
<br />with the intent to commit a sex crime, with the
<br />further purpose of preventing such person from
<br />being admitted to a treatment program under
<br />Proposition 36. According to the author, "Under
<br />current law it is not a crime to possess controlled
<br />substances for sexual predatory purposes. In fact,
<br />unless the perpetrator is apprehended while actually
<br />attempting to drug the victim, he can take shelter
<br />under the treatment provisions of Proposition 36 to
<br />evade accountability. "SB 762 creates a new felony,
<br />punishable by a prison term of three, four, or five
<br />years, and a fine of up to $10,000, for the posses-
<br />sion of a controlled substance with the intent to use
<br />the substance to commit a sex crime. Supported
