Upon approval by City, City shall provide requested funding within seven business days by wire transfer or 25 business days if funded by check, up to the City's total budgeted amount for the program. 9. Energy Solutions shall make available monthly, quarterly and final activity reports to City. 10. Energy Solutions shall return 100 percent of unused City's rebate funds, with no interest, to City within 25 business days of LightWash program's end, March 31, 2004, or termination of this agreement, which ever comes first. 11. This agreement may be terminated by City immediately for cause or upon 30 days written notice, without cause, during the performance of the work. This agreement may be terminated by Energy Solutions upon 30 days written notice to City with or without cause, during the performance of the work. 12. Any notice which City may desire or is required at any time to give or serve Energy Solutions may be delivered personally, or be sent by United States mail, postage prepaid, addressed to Energy Solutions, 1738 Excelsior Avenue, Oakland, CA 94602, attention Ted Pope, or at such other address as shall have been last furnished in writing by Energy Solutions to City. Any notice which Energy Solutions may desire or is required at any time to give or serve upon City may be delivered personally at WATER UTILITY NAME ADDRESS, or be sent by United States mail, postage prepaid, addresse(Ho PROGRAM LEAD, WATER UTILITY NAME ADDRESS, or at such other address as shall have been last furnished in writing by City to Energy Solutions. Such personal delivery or mailing in such manner shall constitute a good, sufficient and lawful notice and service thereof in all such cases.
