RJC:ek:3 /7/60 -7 <br /> R E S O L U T I O N N O. 3008 <br /> RESOLUTION APPROVING AND AUTHORIZING SETTLEMENT OF <br /> EMINENT DOMAIN ACTION NO. 85442, CITY OF REDWOOD <br /> CITY VS. DISTRICT ADVISORY BOARD OF THE NAZARENE <br /> CHURCH, ET AL <br /> WHEREAS, the City of Redwood City has heretofore filed <br /> Eminent Domain Action No. 85442 in the Superior Court of the <br /> State of California, in and for the County of San Mateo, for <br /> condemnation of right of way and easement over and upon certain <br /> real property of the District Advisory Board, Northern California <br /> District, Church of the Nazarene, hereafter referred to as <br /> "Church," which property is situated on Jefferson Avenue and <br /> consists of Lots 18, 19, 20, 21, 22, Block 11, Highlands of <br /> Emerald Lake Subdivision One; and, <br /> WHEREAS, Church has heretofore filed an answer to the <br /> abovementioned action; and, <br /> WHEREAS, City has obtained an Order of Immediate Possession <br /> in the abovementioned action and has proceeded to complete certain <br /> improvements upon and adjacent to the abovementioned real property <br /> of Church, which improvements have resulted in the taking of a <br /> portion of the real property of Church, damage to the remainder <br /> thereof, and changing of the grade of Jefferson Avenue upon which <br /> said real property fronts; and, <br /> WHEREAS, City and Church in good faith have negotiated an <br /> agreement for the settlement of claims and damage resulting from <br /> the abovementioned taking and construction of the abovementioned <br /> improvements by City; and, <br /> WHEREAS, by the terms of said settlement City shall pay to <br /> Church the sum of eight thousand five hundred nine and 12/100 <br /> dollars ($8,509.12) and assign to it City's option to purchase <br /> certain property immediately adjacent and northerly of the <br /> remainder of Church property, described as Lot 17, Block 11, <br /> Highlands of Emerald Lake Subdivision One; <br />
