409 M <br />Legislative Bill Action <br />................................ ............................... <br />The following are summaries of just a few of the legislative bills that are currently being acted upon <br />by the League of California Cities. Public Works Contracts. <br />Compensation of Contractors. AB 453 seeks to <br />change California statutory and case law that have <br />been in place for at least a century. It provides <br />that if a contract with a public agency is declared <br />void, the no payments can be made under it. <br />Competitive bidding laws exist to benefit and <br />enrichment of bidders. AB 453 is similar to AB <br />750 (Brewer), which was vetoed by the Governor <br />in 1998. AB 453 passed out of the Appropriations <br />Committee on May 13. Please send letters of <br />opposition to this bill. Staff: Natasha Fooman; <br />Status: Senate Rules Position: Oppose. <br />ACA 7 (Dutra). Transportation Funding: <br />Sales and Use Tax. ACA 7 authorizes a local <br />transportation agency and a regional transporta- <br />tion agency to impose an additional sales and use <br />tax for a period of 20 to 30 years, as specified, at a <br />rate of 0.5% exclusively for transportation pur- <br />poses within the jurisdiction of the local or regional <br />transportation agency if the additional tax is <br />approved by 55% of the voters of the jurisdiction. <br />This bill passed out Assembly Appropriations on 5/ <br />28. Staff: Natasha Fooman; Status:AsmFlr, <br />Position: Support. <br />AB 1011 (Richman). Califomia Twenty -First <br />Century Infrastructure Investment Fund. <br />Allocations. AB 1011 provides a formula to <br />allocate funds to state and local government from <br />the prospective California Twenty -First Century <br />Infrastructure Investment Fund (Fund). AB 1011 is <br />consistent with the original intent of ACA 11, which <br />establishes the California 21st Century Infrastruc- <br />ture Investment Fund, and beginning in FY 04-05 <br />dedicates a percentage of the growth of the <br />General Fund to meet California's infrastructure <br />needs. Staff: Natasha Fooman, Status:AsApps, <br />Position: Support. <br />HOUSING AND LAND USE <br />AB 1192 (Dutra). Density Reduction. De- <br />veloper Relief. AB 1192 prevents local govern- <br />ments from requiring that developers play a role in <br />identifying a suitable site to be up -zoned to make <br />up the difference in units lost when they want to <br />pursue a building project with a lower density than <br />the a zone specifies. This responsibility is more <br />important now than ever since state law (through <br />last year's AB 2292 (Dutra)) threatens lawsuits <br />against the local government if alternate sites are <br />not concurrently identified. <br />AB 1192 was recently approved on the Assem- <br />bly floor and now awaits further action in the <br />Senate. The League has been involved in negotia- <br />tions with the bill's sponsor, the California Building <br />Industry Association, over amendments to the bill <br />which would address issues with the current bill <br />as well as issues arising from last year's AB 2292. <br />However, given the current form of the bill, cities <br />are strongly urged to send letters in opposition to <br />AB 1192.
