Legislative Bill Action <br />................................ ............................... <br />ties prepare a separate child care element as part <br />of the general plan process. AB 51 requires local <br />agencies, upon the adoption, or amendment, of a <br />city or county's general plan, on or after January 1, <br />2005, for the land use element of the general plan <br />to address the distribution of child care facilities, <br />except family day care homes, as defined. Staff: <br />Dan Carrigg, Status: SenLG; Hrg. -6/18, Position: <br />Review and Comment. <br />AB 170 (Reyes). General Plans. San <br />Joaquin Air Quality District. Cities that are part <br />of the San Joaquin Valley Air Pollution Control <br />District should take a close look at AB 170 be- <br />cause the bill would impose significant mandates <br />upon the local governments within this region. <br />The bill originally dealt with nursing issues, but <br />was radically modified earlier this month, taking <br />affected agencies by surprise. At present, AB 170 <br />requires cities to either adopt a separate air quality <br />element or amend their land use, circulation, <br />housing, conservation and open space elements <br />to include comprehensive goals, policies and <br />implementation strategies for improving air quality. <br />These changes would need to be made within five <br />years or during the next general plan update, <br />whichever is sooner. Much like earlier drafts of AB <br />170, the latest draft of the bill would still require <br />cities modifying specific elements of their general <br />plan to prepare a report on local air quality condi- <br />tions; summarize federal, state and local policies <br />that could improve air quality in the area; and <br />submit the proposed changes to the SJVAPCD. <br />Affected cities should contact their legislators on <br />this bill. AB 304 increases the amount of <br />down payment assistance that can be provided <br />through the Homeownership In Revitalization <br />Areas Program (HIRAP) from three percent to six <br />percent Raising this limit to 6 % would give local <br />agencies the flexibility to provide a greater level of <br />assistance through the program where appropri- <br />ate, albeit to a fewer number of people. AB 304 <br />has passed the Assembly, and the bill is now <br />awaiting further action in the Senate. Staff: Dan <br />Carrigg, Status: SenHou &ComDev, Position: <br />Review and Comment. <br />AB 594 (Leno). California Environmental <br />Quality Act. Bicycle Lanes. AB 594 allows <br />projects involving the re- striping an existing paved <br />right -of -way to create bicycle lanes to qualify for <br />an exemption from the same California Environ- <br />ment Quality Act's (CEQA) requirement exemp- <br />tions enjoyed by "class 4" projects, provided <br />certain conditions are met. Class 4 projects are <br />considered to have minimal impact on the environ- <br />ment and their development is exempt from many <br />CEQA requirements. In particular, the project <br />would need to be consistent with the sections of <br />the city's general plan and supported by findings <br />issued by the local public works director. In <br />addition, the project must not be exposed to <br />potential landslides or floods, cannot be on a <br />hazardous waste site, harm endangered species <br />or habitats, or have a significant effect on histori- <br />cal resources or public health. This legislation <br />was recently passed by the Assembly and now <br />awaits further action in the Senate. Staff: Dan <br />Carrigg, Status: SenRules, Position. Review <br />and Comment. <br />AB 493 (Salinas). CalHome Program. AB <br />493 expands the CalHome program by authorizing <br />the Department of Housing and Community <br />Development to make conditional grants to indi- <br />vidual households for the rehabilitation, repair or <br />replacement of manufactured homes in a mobile <br />home park where the housing is not permanently <br />affixed to a foundation. The CalHome Program is <br />designed to assist low income individuals to <br />become and remain homeowners through the <br />distribution of grant funds and loans. Grant funds <br />and loans are distributed through the program to <br />support a variety of activities that encourage and <br />simplify home ownership.
