YA13 <br />Legislative Bill Action <br />................................ ............................... <br />AS 71 (Horton). Tobacco Retail Licensing. <br />AB 71 (Horton), which would estaulish a statewide <br />program to license tobacco retailers, passed the <br />Assembly Appropriations Committee this week. <br />The bill does not preempt local tobacco licensing <br />programs. The League supports AB 71 as a way <br />to stop the illegal sale of tobacco products, which <br />have both crime and revenue implications for the <br />state and local government. Since the bill was <br />introduced, the League, with assistance from <br />attorneys from the City of Los Angeles, has <br />worked closely with the author's office to craft <br />language that addresses both technical and policy <br />issues of concern to cities. The League thanks <br />the author for being so accommodating and <br />responsive the issues we have raised. AB 71 is <br />now pending on the Assembly Floor. Staff: <br />Yvonne Hunter, Status: Assembly Floor, Posi- <br />tion: Support <br />AB 947 (Jackson). Coastal Erosion. AB 947 <br />addresses the important issue of coastal erosion <br />and how to prevent it. According to the author's <br />office, the bill was introduced to compliment the <br />process currently ongoing within the Resources <br />Agency to develop a statewide coastal erosion <br />policy. Given that the Agency's process is still in <br />progress, AB 947 has become a two -year bill and <br />ultimately will be amended to reflect the finally <br />adopted Coastal Erosion Policy. Cities interested <br />in this issue should review AB 947 and the draft <br />Coastal Erosion Policy, which is available on the <br />Resources Agency website at <br />www.resources.ca.aov/ocean. <br />AB 974 (Nation). Coastal Planning. Native <br />American Sacred Sites. AB 974 would propose <br />a method with which to consider Native American <br />sacred sites within the coastal zone. As <br />amended, it passed the Assembly Appropriations <br />Committee this week and is now pending on the <br />Assembly floor. The issue of how to consider <br />Native American sacred sites is one that has <br />surfaced several times in the last few years in the <br />legislature, starting about three years ago with a <br />solid waste perspective and continuing in other <br />issue areas through this session in AB 974 and <br />SB 18 (Burton). The League has raised several <br />issues with the author's office in an attempt to <br />better understand how the proposed bill would <br />impact coastal cities. Coastal cities should review <br />the current version of AB 974 as amended about <br />May 27, and send their comments to the League's <br />Sacramento office. The League's Environmental <br />Quality Policy Committee will review the bill at its <br />June meeting. Staff: Yvonne Hunter, Status: <br />Pending on Assembly Floor, Position: Review <br />and Comment <br />PUBLIC SAFETY <br />AB 27 (Parra). Sex Offender Registration. <br />AB 27 repeals the sunset date of January 1, 2004 <br />for the statutory provisions regarding local law <br />enforcement responsibility for maintaining public <br />access to specified sex offender information. <br />Also, AB 27 expresses the intent of the Legislature <br />to consider posting sex offender information on <br />the Internet if the United States Supreme Court <br />upholds laws permitting the posting of such <br />information. The League supports the sunset <br />repeal so that information remains accessible to <br />those individuals interested in learning more about <br />public safety within their respective community. If <br />this same information may eventually be posted <br />on the Internet and maintained by the Department <br />of Justice, local law enforcement would likely be <br />relieved of a considerable portion of the customer <br />service responsibilities associated with providing <br />the sex offender information. Existing law <br />prohibits a juvenile convicted of specified offenses <br />from possessing a firearm until age 30. AB 319 <br />would add possession of a concealed or loaded <br />gun, and allowing a loaded gun to be brought into <br />a vehicle, to the list of serious offenses for which <br />conviction results. Violation is punishable by up to <br />one year in the county jail, or by 16 months, two, <br />or three years in state prison, and /or by a fine of <br />up to $1,000.
