These items can be referenced <br /> in their original context in Attachment 10 to the Staff Report. <br /> The subsequent text directly following the appellant statements has been provided by <br /> City staff as a response. <br /> Offer of Proof.• <br /> Thc� legal basis_for this challenge is that the City failed to follow its own architectural gutdelines <br /> set_ forth in Article 45, Section 45.8, Architectural Standards, Standurds B., C., and E., and other <br /> provisions of the Redwood City Zoning Code and other ordinances, rules, regulations, and <br /> practices Appellants believe ti+�ould suppnrt Appellants' Appeal ("Gurdelines'), and, where <br /> applicable, also failed to follow various State and Federal law and regulations, as well. <br /> Staff Response: The Zoning Administrator's decision to approve the Architectural <br /> Permit (AP2010-09) is consistent with the requirements of the Redwood City Zoning <br /> Ordinance, including the Architectural Standards provided in Article 45, Sectian 45.8. <br /> Specific discussion regarding Architectural Standards B., C., and E. can be referenced <br /> in the Notice of Official Action (Attachment 3), the staff report, and the additional <br /> discussion provided below. <br /> Offer of Proof with Respect to Standard E arrd the Italiart Stone Pine ( "Tree ") <br /> 1. Sereral dif�erent urborists have infnrmally informed Mr. Warsowe that there are a <br /> number of options avuilable to save the Tree needless destruction, e>>en given the currenlly <br /> approved plans. Appellants would huve been able to demonstrate: <br /> a. That the two co-dominant trunks of the Tree could have been wired together to <br /> provide adequate structural support; and/or <br /> b. The co-dominant trunk over Appellants ' property coudd have been trin7n7ed tn reduce <br /> tlae weight qf that h�tcnk; or <br /> c. The co-dominant trunk could have been removed and the resulting Tree wnuld be <br /> structurally sound. <br /> Staff Response: In review of the project application, the Zoning Administrator <br /> considered multiple options with regard to the Italian Stone Pine, including retention of <br /> An Equal Opportunity / Equal Access Program dedicated to opening the doors of equal opportunity <br /> to a!! residents and users of Redwood CIty programs, services and facilities. <br />
