8.A <br /> Page 84 <br /> Conclusions of Fact and Lativ that Appellants tivould have Demonstrated: The City <br /> administration_fuiled in it.s duty tv provide Appellants with adequate time to prepare for this <br /> Hearing, and, in doing so, viulated Appellarrts' rights to due pracess and c�qual protcciion. <br /> Staff Response: The City Council has not made a determination as to the appellants' <br /> request for continuance, and will consider the appellants' request during the Public <br /> Hearing on the appeal. Staff does wish to clarify that the City's deadlines for submittal <br /> of agenda items and staff reports pertain to staff. In order to meet internal circulation <br /> requirements, City staff must submit staff reports to the City Clerk's office 2 weeks prio� <br /> to the City Council meeting. By law, the agenda for a City Council meeting must be <br /> posted within 72 hours of the meeting. The City provides staff reports along with the <br /> agenda for each item to be considered at the meeting. <br /> Under Article 48, Section 48.2, every appeal must be made in writing within seven (7) <br /> days of the final decision being appealed. The appeal must state the grounds upon <br /> which the appeal is based and be accompanied by any supporting information the <br /> appellant wishes the City Council to consider during the appeal. The appellants <br /> submitted a timely appeal, but initially provided no basis for the appeal (Attachment 4). <br /> The City Clerk afforded the appellants the opportunity to submit the information required <br /> under the Redwood City Zoning Ordinance, including the basis for the appeal and any <br /> supporting information the appellants wished the City Council to consider. However, the <br /> appellants were informed that in order for supporting information to be included in the <br /> staff report, the information must be submitted by October 22, 2010 in order to give staff <br /> sufficient time to complete the staff report by the staff s deadline (Attachment 5). In this <br /> case, the public hearing is scheduled for November 22, 2010. Despite the City's self- <br /> established deadline for staff reports to be completed by November 8, 2010the City <br /> allowed information to be submitted for inclusion with the Staff Report as late as <br /> November 17, 2010 (Attachment 10 & 15). Thus, the appellants' have been afforded <br /> ample opportunity to respond to the Zoning Administrator's decision. To the extent the <br /> appellant seeks to provide further response, the appellant will have such opportunity at <br /> the Public Hearing. <br /> 16 <br />
