• • <br /> 1 FRANCHISE AGREEMENT <br /> 2 FOR <br /> 3 RECYCLABLE MATERIALS, ORGANIC MATERIALS, AND SOLID WASTE <br /> 4 COLLECTION SERVICES <br /> 5 <br /> 6 THIS AGREEMENT is made as of this day of i,IL4 , 20k, by and <br /> 7 between the City of Redwood City, a charter city and municipal corporati. n of the State of <br /> 8 California ( "Agency "), and RECOLOGY SAN MATEO COUNTY, a - fornia corporation <br /> 9 ( "Contractor "). <br /> 10 RECITALS <br /> 11 1. The State of California has, through enactment of the California Integrated Waste <br /> 12 Management Act of 1989 ( "Act "), determined each of the following: <br /> 13 A. That management of solid waste is a shared responsibility of the State <br /> 14 and local governments. <br /> 15 B. That it is in the public interest for local governments to be authorized and <br /> 16 required to provide adequate solid waste handling services. <br /> 17 C. That the amount of solid waste generated in California, coupled with <br /> 18 diminishing landfill space, potential adverse environmental impacts from <br /> 19 Iandfilling solid waste, and the need to conserve natural resources have <br /> 20 created an urgent need for State and local agencies to enact and <br /> 21 implement an aggressive integrated waste management program. <br /> 22 2. The State of California, through the Act, has directed the California Integrated <br /> 23 Waste Management Board and all local agencies to maximize the use of feasible <br /> 24 waste reduction, recycling and composting options in order to reduce the amount <br /> 25 of solid waste that must be disposed of in landfills. <br /> 26 3. Agency is a member of the South Bayside Waste Management Authority <br /> 27 ("Authority" or "SBWMA"), established pursuant to the California Joint Exercise of <br /> 28 Powers Act. In November, 2007, the Authority, acting on behalf of Agency and its <br /> 29 other members, issued a Request for Proposals to provide collection of solid <br /> 30 waste, recyclable materials, and organic materials and related services to <br /> 31 Agency and other members of Authority. <br /> 32 4. Contractor submitted a proposal to provide these services, which was evaluated <br /> 33 by the Authority. On the basis of that evaluation, the Authority has <br /> 34 recommended that Agency enter into an agreement with Contractor. <br /> 35 5. Agency has independently evaluated Contractor's proposal and has determined <br /> 36 that Contractor has proposed to provide solid waste handling services including <br /> 37 Collection of Recyclable and Organic Materials in a manner and on terms which <br /> 38 are in the best interests of Agency, its residents and businesses, taking into <br /> 39 account the qualifications and experience of Contractor and the cost of providing <br /> 40 such services. <br /> Franchise Agreement for Collection Services with Recology San Mateo County <br /> City of Redwood City <br /> ATTY /AGR/2010.014 <br /> 040510 Page 1 of 1 l5 <br />
