The Agency may require Contractor to <br /> 2633 reassign an employee, if the employee has conducted himself or herself <br /> 2634 inconsistently with the terms of this Agreement. <br /> 2635 Contractor shall adopt policies and procedures consistent with State and federal law <br /> 2636 that ensure a sober and drug -free workplace. This includes strictly prohibiting <br /> 2637 unlawful manufacture, distribution, possession, or use of any controlled substance <br /> 2638 in the workplace, regardless of whether the employee is on duty at the time. <br /> 2639 Further, the policies and procedures shall prohibit an employee from operating <br /> 2640 either Agency or Contractor equipment and vehicles (whether on or off duty) while <br /> 2641 under the influence of alcohol or drugs. The purpose of these policies and <br /> 2642 procedures is to ensure workplace safety, productivity, efficiency, and the quality of <br /> 2643 Contractor's service to Customers. <br /> 2644 K. Uniforms. While performing services under this Agreement, all Contractor's <br /> 2645 employees performing field service shall be dressed in clean uniforms and shall <br /> 2646 wear visible identification that include the employee's name and /or employee <br /> 2647 number, and Contractor's name. Uniform type, style, colors, and any modifications <br /> 2648 may be subject to approval by the Agency. <br /> 2649 8.07 HAZARDOUS WASTE INSPECTION AND HANDLING <br /> 2650 A. Inspection Program and Training. Contractor is required to inspect Solid Waste, <br /> 2651 Targeted Recyclable Materials, Organic Materials, and other materials put out for <br /> 2652 Collection and may reject Solid Waste, Targeted Recyclable Materials, Organic <br /> 2653 Materials, and other materials observed to be contaminated with Hazardous Waste <br /> 2654 and not Collect Hazardous Waste put out with Solid Waste, Targeted Recyclable <br /> 2655 Materials, and Organic Materials. Contractor shall develop a load inspection <br /> 2656 program that includes the following components: (i) personnel and training; (ii) load <br /> 2657 checking activities; (iii) management of wastes; and (iv) record keeping and <br /> 2658 emergency procedures. <br /> 2659 Contractor's load checking personnel, including its Collection vehicle drivers, shall <br /> 2660 be trained in: (i) the effects of Hazardous Substances on human health and the <br /> 2661 environment; (ii) identification of prohibited materials; and (iii) emergency <br /> 2662 notification and response procedures. Collection vehicle drivers shall inspect <br /> 2663 Containers before Collection when practical. <br /> 2664 B. Response to Hazardous Waste Identified During Collection. Under no <br /> 2665 circumstances shall Contractor's employees knowingly Collect Hazardous Waste or <br /> 2666 remove unsafe or poorly containerized Hazardous Waste from a Collection <br /> 2667 Container. If Contractor determines that material placed in any Container for <br /> 2668 Collection is Hazardous Waste or other material that may not legally be accepted or <br /> 2669 safely processed at the Designated Transfer and Processing Facility or presents a <br /> 2670 hazard to Contractor's employees, or those at the Designated Transfer and <br /> 2671 Processing Facility, the Contractor shall have the right to refuse to accept such <br /> 2672 material. The Generator shall be contacted by the Contractor and requested to <br /> 2673 arrange proper Disposal. If the Generator cannot be reached immediately, the <br /> 2674 Contractor shall, before leaving the Premises, leave a non - collection notice, which <br /> 2675 indicates the reason for refusing to Collect the material and lists the phone number <br /> 2676 for the San Mateo County Household Hazardous Waste Facility, or other resources <br /> Franchise Agreement for Collection Services with Recology San Mateo County <br /> City of Redwood City <br /> ATTY /AGR/2010.014 <br /> 040510 Page 66 of 115 <br />
