i • <br /> 2723 Hazardous Waste found or observed in Solid Waste, Targeted Recyclable <br /> 2724 Materials, Organic Materials, Electronic Waste, Universal Waste, and Construction <br /> 2725 and Demolition Debris anywhere within Service Area. In addition to other required <br /> 2726 notifications, if Contractor observes any substances which it or its employees <br /> 2727 reasonably believe or suspect to contain Hazardous Wastes unlawfully Disposed of <br /> 2728 or released on any Agency property, including storm drains, streets or other public <br /> 2729 rights of way, Contractor will immediately notify the Agency and SBWMA. <br /> 2730 All records required by regulations shall be maintained at the Contractor's Facility. <br /> 2731 These records shall include: waste manifests, waste inventories, waste <br /> 2732 characterization records, inspection records, incident reports, and training records. <br /> 2733 Contractor shall maintain records showing the types and quantities, if any, of <br /> 2734 Hazardous Waste found in Solid Waste, Targeted Recyclable Materials, and <br /> 2735 Organic Materials which was inadvertently Collected from Customers within the <br /> 2736 Service Area, but diverted from landfilling. <br /> 2737 8.08 COMMUNICATION AND COOPERATION WITH AGENCY <br /> 2738 A. Communications. The Contractor's general manager shall have e-mail capabilities <br /> 2739 to enable the Agency and the Contractor's general manager to communicate via e- <br /> 2740 mail. Contractor's general manager shall respond to Agency email correspondence <br /> 2741 within twenty -four (24) hours. <br /> 2742 B. Monthly Meetings. Upon request from Agency, beginning on the Commencement <br /> 2743 Date, and then on a monthly basis thereafter, Contractor shall meet with the Agency <br /> 2744 to discuss progress of each active diversion program, quality and reliability of <br /> 2745 Collection services, and compliance with the terms of the Agreement. SBWMA may <br /> 2746 attend and participate in these meetings. At each monthly meeting, the Agency, <br /> 2747 Contractor and SBWMA, if attending, shall have the opportunity to present and <br /> 2748 discuss proposed changes in service such as changing program requirements or <br /> 2749 modifying Collection methods. <br /> 2750 C. Inspection by Agency. Agency shall have the right, but not the obligation, to <br /> 2751 observe and inspect all of the Contractor's operations under this Agreement. In <br /> 2752 connection therewith, Agency shall have the right to enter facilities used by <br /> 2753 Contractor during operating hours, speak to any of Contractor's employees and <br /> 2754 receive cooperation from such employees in response to inquiries. In addition, <br /> 2755 upon reasonable notice and without interference with Contractor's operations, <br /> 2756 Agency may review and copy any of Contractor's operational and business records <br /> 2757 related to this Agreement. If Agency so requests, Contractor shall make specified <br /> 2758 personnel available to accompany Agency employees on inspections and shall <br /> 2759 provide electronic copies of records stored in electronic media. <br /> 2760 8.09 COOPERATION WITH DESIGNATED TRANSFER AND PROCESSING FACILITY <br /> 2761 OPERATOR <br /> 2762 A. Communications. If requested by SBWMA, the Contractor shall meet with the <br /> 2763 SBWMA and Operator at least once each month to discuss issues related to the <br /> 2764 interaction of operations between Contractor and Operator including, but not limited <br /> 2765 to: <br /> 2766 1.
