6.3A <br /> Page 41 <br /> 1 7. weight �- of all Solid Waste, Piant Materials, Organics Materials, inerts, <br /> 2 I and Construction and Demolition Debris and Other leaving the Shoreway Center; <br /> 3 8. weight and volume of all materials moving between the buildings and operations <br /> 4 on the Shoreway Center site (e.g. between the MRF building, Transfer Station <br /> 5 building and Buyback center) (by material type); <br /> 6 9. mass balance accounting of all materials that enter and leave the Shoreway <br /> 7 Cente� so that all inbound tons equal outbound / shipped materials less inventory <br /> 8 (by material type); <br /> 9 10. location to which all Solid Waste, Plant Materials, Organics Materials, and <br /> 10 Construction and Demolition Debris received by the Facilities were delivered for <br /> 11 transfer, processing, ultimate use or disposal; <br /> 12 Contractor shall utilize the appropriate reporting forms in Attachment 15. <br /> 13 B. Undisputed sums will be paid by Contractor and Authority within fifteen (15) days <br /> 14 from the date the Authority receives the statement. <br /> 15 C. Authority may request additional information regarding a report within thirty (30) days <br /> 16 from receipt. Such request shall be in writing and shall describe the information <br /> 17 requested with reasonable specificity. Contractor shall furnish the requested <br /> 18 information to Authority within thirty (30) days from the date of the request. Authority <br /> 19 shall notify Contractor within thirty (30) days after receipt of the initial report and <br /> 20 payment, or within thirty (30) days after receipt of the additional information if such <br /> 21 information is requested, of any dispute as to the accuracy of the report and the <br /> 22 amount of the payment. <br /> 23 8.08 ANNUAL CALCULATION AND RECONCILIATIONS <br /> 24 Adjustments to Contractor's Compensation may be due for one or more of the following: <br /> 25 A. Shortfall of Recycling Revenue Guarantee (Section 7.07.A) <br /> 26 B. Additional share of Recycling Revenue over Revenue Guarantee for MRF Residue <br /> 27 control (Section 7.07.D.3) <br /> 28 C. Minimum Self-Haul Diversion Guarantee (Section 7.08.A) <br /> 29 D. Reconciliation of Self-Haul Gate Fee Collections (Section 7.10) <br /> 30 The Authority will calculate the amounts, if any, due from Contractor or due to <br /> 31 Contractor, and will provide Contractor with its calculations and supporting information <br /> 32 on or before January 31 e�for each Rate Year beginning January 31, 2011. If <br /> 33 Contractor requests, Authority shall meet with Contractor during the month of February <br /> 34 to discuss the calculations, will attempt to answer any questions that Contractor may <br /> 35 have, and will endeavor to resolve objections that Contractor may have. <br /> 36 � Contractor shall pay or the Authority shall pay the amount due, as initially calculated or <br /> 37 as subsequently adjusted by Authority, within thirty (30) days after receiving the <br /> 38 I Authority's initial or adjusted calculation. <br /> 39 8.09 LIQUIDATED DAMAGES <br /> 40 Liquidated damages will be paid by Contractor as provided in Section 11.07. <br /> Operating Agreement for Shoreway Center <br /> Page - 32 - 7r�oio9 <br />
