6.3A <br /> Page 47 <br /> 1 • Products and Completed Operations (including protection against liability <br /> 2 resulting from use of Recyclable Materials by another person); <br /> 3 • Personal Injury Liability with employment exclusion deleted; <br /> 4 • Broad Form Blanket Contractual with no exclusions for bodily injury, personal <br /> 5 injury or property damage (including coverage for the indemnity obligations <br /> 6 contained herein); <br /> 7 • Owned, Non-Owned, and Hired Motor Vehicles; <br /> 8 • Broad Form Property Damage. <br /> 9 The comprehensive general liability insurance shall be written on an "occurrence" <br /> 10 basis (rather than a"claims made" basis) in a form at least as broad as the most <br /> 11 current version of the Insurance Service Office commercial general liability <br /> 12 occurrence policy form (CG0001). If occurrence coverage is not obtainable, <br /> 13 Contractor must arrange for "tail coverage" on a claims made policy to protect <br /> 14 Authority from claims filed within four years after the expiration or termination of <br /> 15 this Agreement relating to incidents that occur�ed prior to such expiration or <br /> 16 termination. Any excess or umbrella policies shall be on a"following form" basis. <br /> 17 3. Pollution Liabilitv. Contractor shall maintain pollution liability insurance with limits <br /> 18 in an amount of not less than Ten Million Dollars ($10,000,000) per occurrence <br /> 19 and annual aggregate covering claims for on-site, under-site, or off-site bodily <br /> 20 injury and property damage as a result of pollution conditions arising out of its <br /> 21 ope�ations under this Agreement. <br /> 22 4. Hazardous Materials Storacae and Transqort. Contractor shall maintain insurance <br /> 23 coverage of not less than Ten Million Dollars ($10,000,000) for personal injury, <br /> 24 bodily injury and property damage arising out of the sudden and accidental <br /> 25 release of any hazardous materials or wastes during storage at facilities operated <br /> 26 by Contractor or transport of such materials by vehicles owned, operated or <br /> 27 controlled by Contractor in the performance of the services required under this <br /> 28 Agreemer�t. <br /> 29 5. Phvsical Damaqe. Contractor shall maintain comprehensive (fire, theft and <br /> 30 collision) physical damage insurance covering the vehicles and equipment used <br /> 31 in providing service to Authority under this Agreement, with a deductible or self- <br /> 32 insured retention not greater than One Hundred Thousand Dollars ($100,000). <br /> 33 Notwithstanding the foregoing, Contractor shall be allowed to self-insure for <br /> 34 physical damage to its vehicles provided Contractor provides adequate audited <br /> 35 �nancial information to Authority and Authority is reasonably satisfied that <br /> 36 Contractor has the financial net worth to cover any losses. <br /> 37 B. Acceptabilitv of Insureds. The insurance policies required by this section shall be <br /> 38 issued by an insurance company or companies admitted to do business in the State <br /> 39 of California, subject to the jurisdiction of the California lnsurance Commissioner, <br /> 40 and with a rating in the most recent edition of BesYs Insurance Reports of size <br /> 41 category XV or larger and a rating classification of A+ or better. <br /> 42 C. Required Endorsements. Without limiting the generality of Sections 10.02.A and B, <br /> 43 the policies shall contain endorsements in substantially the following form: <br /> Operating Agreement for Shoreway Center <br /> Page - 38 - �/30/09 <br />
