' 6.1 B , <br /> Page 1 ! <br /> i <br /> REPORT I � <br /> To the Honorable Mayor and City Council <br /> From the Ci Mana er <br /> December 6, 2010 , <br /> SUBJECT ' <br /> Amendment No 1 to professional services agreement with Abey Arnold Associates for '� <br /> the Fair Oaks Childcare Center Play Area, Dove Beeger and Westwood parks ' <br /> renovation projects. i <br /> RECOMMENDATION <br /> Approve, by motion, Amendment No 1 in the amount of $9,960.00 to the professional <br /> services agreement with Abey Arnold Associates for a total not-to-exceed contract value , <br /> of $68,660.00. <br /> BACKGROUND <br /> The city previously contracted with landscape architects Abey Arnold Associates on <br /> September 9, 2009 to provide services including design, public involvement and <br /> construction support for the renovation projects at Fair Oaks Childcare Center, Dove <br /> Beeger and Westwood parks. Abey Arnold was selected to pertorm this work <br /> subsequent to a Request for Qualifications process. The fee for the original scope of <br /> work totaled $58,700.00. The agreement was approved by the City Manager compliant <br /> with the city's pu�chasing guidelines. Staff requests Council approval of Amendment No. <br /> 1 as amount of the original agreement and the proposed amendment, in aggregate, <br /> exceeds $60,000.00 and now requires Council approval. <br /> Due to changes in the scope of work over the term of these projects, the consultant has <br /> requested additional fees as compensation for their additional time to expedite the <br /> project and their additional work due the expanded scope. <br /> Prior to the public input and design phase, the scope of these three play area <br /> renovations was limited to replacing play equipment and increasing accessibility <br /> pursuant to Americans with Disabilities Act. That scope expanded as a result of the <br /> input received from park users at various community meetings. Designs now include <br /> improvements to drainage, irrigation, planting, special play surfaces, fencing, and <br /> expanded pfay areas. The increased scope of work has necessarily resulted in <br /> additional work hours for the consultant. <br /> Council has recently awarded the construction contracts for all three play area <br /> renovation projects. Construction of improvements at the Fair Oaks Childcare Center <br /> was awarded for $173,143.00 on October 11, 2010. Construction of improvements at <br /> Dove Beeger and Westwood parks was awarded for $342,082.00 on November 22, <br /> 2010. The consultant's fees for services, including design and construction support, are <br /> 13.3% of the construction contract value ($515,225.00) for all three projects. <br /> The proposed does not constitute a proje�t as defined by the California Environmental <br /> Quality Act and therefore requires no environmental review. <br />
