ATTACP ge 2� <br /> and pursue such foreclosure proceedings to judgment and sale; provided that the City need not l <br /> commence or pursue such proceedings with respect to any property owned by a single property � <br /> owner who is delinquent in the payment of Special Taxes in an amount less than $15,000 if both � <br /> (i) the aggregate amount of such delinquent Special Taxes does not exceed 5% of the total <br /> Special Taxes due and payable for the Fiscal Year in question, and (ii) the balance on deposit in <br /> the Series 2011 Reserve Fund is not less than the Reserve Requirement. <br /> Under the Act, foreclosure proceedings are instituted by the bringing of an action in the <br /> superior court of the county in which the parcel lies, naming the owner and other interested !� <br /> persons as defendants. The action is prosecuted in the same manner as other civil actions. In I <br /> such action, the real property subject to the special taxes may be sold at a judicial foreclosure i <br /> sale for a minimum price which will be sufficient to pay or reimburse the delinquent special <br /> taxes. <br /> The owners of the Bonds benefit from the Reserve Fund established pursuant to the <br /> Fiscal Agent Agreement; however, if delinquencies in the payment of the Special Taxes with <br /> respect to the Bonds are significant enough to completely deplete the Reserve Fund, there <br /> could be a default or a delay in payments of principal and interest to the owners of the Bonds <br /> pending prosecution of foreclosure proceedings and receipt by the City of the proceeds of <br /> foreclosure sales. Provided that it is not levying the Special Tax at the annual Maximum Special <br /> Tax rates set forth in the Special Tax Formula, the City may adjust (but not to exceed the annual <br /> Maximum Special Tax) the Special Taxes levied on all property within the District subject to the I <br /> Special Tax to provide an amount required to pay debt service on the Bonds and to replenish <br /> the Reserve Fund. <br /> Under current law, a judgment debtor (property owner) has at least 140 days from the <br /> date of service of the notice of levy in which to redeem the property to be sold. If a judgment <br /> debtor fails to redeem and the property is sold, his or her only remedy is an action to set aside � <br /> the sale, which must be brought within 90 days of the date of sale. If, as a result of such an <br /> action a foreclosure sale is set aside, the judgment is revived and the judgment creditor is <br /> entitled to interest on the revived judgment as if the sale had not been made (California Code of <br /> Civil Procedure Section 701.680). <br /> Foreclosure by court action is subject to normal litigation delays, the nature and extent of <br /> which are largely dependent upon the nature of the defense, if any, put forth by the debtor and <br /> the condition of the calendar of the superior court of the county. Such foreclosure actions can <br /> be stayed by the superior court on generally accepted equitable grounds or as the result of the <br /> debtor's filing for relief under the Federal bankruptcy laws. The Act provides that, upon <br /> foreclosure, the Special Tax lien will have the same lien priority as is provided for ad valorem <br /> taxes and special assessments. See "APPRAISAL OF PROPERTY WITHIN THE DISTRICT — <br /> Priority of Lien." <br /> No assurances can be given that the real property subject to a judicial foreclosure sale <br /> will be sold or, if sold, that the proceeds of sale will be sufficient to pay any delinquent Special <br /> Tax installment. The Act does not require the District to purchase or otherwise acquire any lot <br /> or parcel of property foreclosed upon if there is no other purchaser at such sale. <br /> Section 53356.6 of the Act requires that property sold pursuant to foreclosure under the <br /> Act be sold for not less than the amount of judgment in the foreclosure action, plus post- <br /> judgment interest and authorized costs, unless the consent of the owners of 75% of the <br /> outstanding Bonds is obtained.
