12/06/2010 ORIGINAL RESOLUTION NO. 15068 RESOLUTION OF NOTICE OF INTENT TO VACATE CHEMICAL WAY IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of Division 9 of the California Streets and Highways Code, the City Council of the City of Redwood City ( "City Council "), hereby declares its intention to vacate a City right -of -way known as Chemical Way located in the Woodhouse Industrial Park Area; and WHEREAS, because there are in -place utilities that are in use, vacation of Chemical Way is subject to a reservation and exception from vacation of an easement and right to construct, maintain, operate, replace, remove, or renew public utility facilities, unless the City Council determines the public convenience and necessity require otherwise; and WHEREAS, attached to Exhibit 1 (Public Hearing Notice.) is a map or plan and legal description that shows the area intended to be vacated; and WHEREAS, pursuant to said provisions of the California Streets and Highways Code, notice of intention to vacate the herein described portion of the Woodhouse Industrial Park Property shall be published and posted in substantially the form attached hereto as Exhibit 1; and WHEREAS, a noticed public hearing on the question of vacating Chemical Way, as described below, shall be held and evidence thereon received by the City Council on December 21, 2010; and WHEREAS, City declares its intention to vacate the property herein described subject to the following conditions being satisfied to the satisfaction of the City Engineer: 1. That the County has acquired fee title to the entirety of the Woodhouse Industrial Park Property; 2.
