12/06/2010 <br /> ORIGINAL <br /> RESOLUTION NO. 15068 <br /> RESOLUTION OF NOTICE OF INTENT TO VACATE CHEMICAL WAY <br /> IN THE CITY OF REDWOOD CITY PURSUANT TO PART 3 OF <br /> DIVISION 9, CALIFORNIA STREETS AND HIGHWAYS CODE OF THE <br /> STATE OF CALIFORNIA <br /> WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) <br /> of Division 9 of the California Streets and Highways Code, the City Council of the City of <br /> Redwood City ( "City Council "), hereby declares its intention to vacate a City right -of -way <br /> known as Chemical Way located in the Woodhouse Industrial Park Area; and <br /> WHEREAS, because there are in -place utilities that are in use, vacation of <br /> Chemical Way is subject to a reservation and exception from vacation of an easement <br /> and right to construct, maintain, operate, replace, remove, or renew public utility <br /> facilities, unless the City Council determines the public convenience and necessity <br /> require otherwise; and <br /> WHEREAS, attached to Exhibit 1 (Public Hearing Notice.) is a map or plan and <br /> legal description that shows the area intended to be vacated; and <br /> WHEREAS, pursuant to said provisions of the California Streets and Highways <br /> Code, notice of intention to vacate the herein described portion of the Woodhouse <br /> Industrial Park Property shall be published and posted in substantially the form attached <br /> hereto as Exhibit 1; and <br /> WHEREAS, a noticed public hearing on the question of vacating Chemical Way, <br /> as described below, shall be held and evidence thereon received by the City Council on <br /> December 21, 2010; and <br /> WHEREAS, City declares its intention to vacate the property herein described <br /> subject to the following conditions being satisfied to the satisfaction of the City Engineer: <br /> 1. That the County has acquired fee title to the entirety of the Woodhouse Industrial <br /> Park Property; <br /> 2.
