RC Peninsula Park, LLC <br /> RELEASE OF ALL CLAIMS <br /> Project Name: <br /> Project Description: <br /> Project No: <br /> In consideration of final payment of undisputed contract amounts relating to the above - <br /> referenced Work, Contractor hereby releases RC Peninsula Park, LLC ( "Owner ") from <br /> any and all claims for payment on the Work, except for any disputed work arid any <br /> disputed amounts set forth below: <br /> DESCRIPTION OF DISPUTED WORK CHECK IF NONE: <br /> DESCRIPTION OF DISPUTED AMOUNTS CHECK IF NONE: <br /> Contractor acknowledges that it has been advised by its attorneys concerning, and is <br /> familiar with, the provisions of California Civil Code Section 1542, which provides as <br /> follows: <br /> A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE <br /> CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR <br /> AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY <br /> HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH <br /> THE DEBTOR. <br /> Contractor, in that connection, acknowledges that it may have sustained damages, <br /> losses, costs or expenses that are presently unknown to Contractor or damages, <br /> losses, costs or expenses which have already been sustained but which may give rise <br /> to additional damages, losses, costs or expenses in the future. Nevertheless, <br /> Contractor acknowledges that this Release has been negotiated and agreed upon in <br /> light of that situation, and hereby expressly waives any and all rights which it may have <br /> under California Civil Code Section 1542 or under any other state or federal statutes or <br /> common law principle of similar effect. <br /> Dated: <br /> 1381816v1 <br />
