01/10/2011 <br /> The City may require that a request for family leave be supported <br /> by a certification issued by the employee's health care provider. <br /> Certification may also be required from the health care provider of <br /> the employee's child, parent or spouse who has a serious health <br /> condition before the employee is approved to use family /medical <br /> leave to take care of that family member. <br /> Failure to comply with the above requirements may lead to denial of <br /> leave. <br /> 18.14.3 The employee may elect, or the City may require the employee, to <br /> substitute accrued vacation leave or other accrued time off during <br /> family /medical leave. Sick leave may be used during the period of <br /> family /medical leave in accordance with the sick leave provisions <br /> found in Section 18.1 of this Memorandum of Understanding. <br /> 18.14.4 The City will maintain contributions for the employee's health <br /> benefits under group health plans at the same level as prior to the <br /> leave, in accordance with the Family and Medical Leave Act. The <br /> worker may return to the same position, or another position with <br /> equivalent benefits, pay and other terms and conditions of <br /> employment upon completion of the leave. <br /> 18.15 Integration with Long Term Disability Plan <br /> At the point an employee, who is on leave for a non - industrial injury or illness, <br /> qualifies for integration of sick leave benefits through his /her Long Term <br /> Disability (LTD) Plan, the employee may elect to choose one of the integration <br /> options available to them through their plan. Please refer to LTD plan <br /> document for option details. <br /> SECTION 19 — HEALTH AND CAFETERIA PLAN <br /> 19.1 Health and Cafeteria Plan <br /> 19.1.1 The City agrees to contract with The California Public Employee's <br /> Retirement System (PERS) for participation under the Public <br /> Employees Medical and Hospital Care Act (Government Code <br /> Section 22751, et seq.) pursuant specifically to Government Code <br /> Sections 22892 and 22850, provided however, that upon the <br /> request of the City, the parties will re -open this Article 19.1.1 to <br /> provide a different group health plan. <br /> 19.1.2 For the period January 1, 2010 through December 31, 2010, the <br /> City's maximum contribution for each active employee for a Health <br /> 42 <br /> Page 48 #15077 <br /> MUFF # 905 <br />
