6.2B <br /> REPORT <br /> To the Honorable Mayor and City Council , <br /> From the Cit Mana er <br /> January 24, 2011 <br /> S U BJ ECT <br /> Authorize City Attorney and City Manager to Administer and Manage Claims and <br /> Actions Against the City within Specified Amounts. <br /> RECOMMENDATION <br /> Approve a resolution delegating authority to City Attomey and City Manager to <br /> administer and manage claims and actions against the City of Redwood City or its <br /> officers or employees and claims and actions of the City of Redwood City. <br /> BACKGROUND <br /> Since 2002, the City Manager or designee has been authorized to compromise claims <br /> and actions against the City or initiated by the City in an amount not to exceed $15,000 <br /> for general liability claims and $30,000 for workers compensation claims. These <br /> amounts are relatively low and require that most claims go to the City Council for <br /> approval which at times delays the prompt resolution of matters that are not particularly <br /> significant. <br /> State law allows the Council to delegate authority to staff to resolve claims but far <br /> charter cities, like Redwood City, this amount may not exceed $50,000. If approved by <br /> the City Council, the City Attorney would be authorized to allow, deny, deny in part, <br /> settle, or compromise any claim or action by or against the City in an amount not to <br /> exceed $25,000. The City Manager would be similarly authorized in an amount not to <br /> exceed $50,000, with the written concurrence of the City Attorney. <br /> ALTERNATIVES <br /> 1. The Council could take no action and current authority would remain in effect. <br /> 2.
