6.2A � <br /> Page 5 � <br /> ASSOCIATION OF BAY AR�A GOVF,RNMENTS �IITACHANEI�T � � <br /> Agreement for Local Agency Participation in Grant-Funded <br /> Bay Area-wide Trasl� Capiure Demonstra6on Project <br /> This agreement is made and entered into cffective , 2010, by and between the Association of Bay <br /> Area Governments {ABAG), a public entity farmed under the California Joint Exercise of Powers Act, <br /> Government Code Seccions G500, e! seq. and the City of Redwood City (Redwood City), a City. <br /> Recitals <br /> A. ABAG and the California State Water Resources Controf I3aard (State Water IIoard) have entered into I'roject <br /> Finance Agreement No. 09-823-550 (PFA) in the amouni of $5,000,000 (five million dollars) for Clexn Water <br /> State Revolving Fund Project No. C-OG-G441-110, the Bay Area-wide 7rash Capture Demonstration Project <br /> (E'r�ject). Punding is provided by the federal American Recove�y and Reinveshnent Act of 2009 (ARRA). <br /> "The PFA and amendments are locatcd at http;//wrvw.bt�varcatrnshtrACker.or�/content/contraet-resources <br /> B. 'The Project is comprised of the following elements: acquisitiou of trash capture devices (TCDs), provision <br /> and/or installation of TCDs in existing storm drainage infrastructure, maintenance of installed TCDs a�id <br /> monitoring of installed 7'CDs. <br /> C. Redwood City is one of many local government entities that are eligible to participate in the Project <br /> (collectively, "Potentisl .Participants") by facilitating inst allation of the TCDs in its existing storm drainage <br /> infr�structure and by maintai�ling and monitorin� installed TCDs, as set forth in the attached ��l�ibit Scope <br /> of Work, whicli is incorporated herein by tl�is reference. <br /> D. ABAG issued Requests for Propasals far small ca�acity trash capture devices (small TCDs) and for high flow <br /> capacity tr�sh capCUre devices (lar�;e TCDs) (col[ectively, "TCDs") and assembled a panel of vendors for <br /> devices in both categories that can meet minimum trash capture permit requirements when properly installed <br /> and maintained. <br /> E. ABAG has conttacted with each vendor on tl�e panel to furnisl�, and if requested, install small TCDs selected <br /> by Participatin� Entities [as defined in section 2(a)]; and to provide large TCDs; and for ABAG to pay the <br /> cost thereof. <br /> F. AL�AG has made an initial determination that each Potential Aarticipant wil] have access to a portion of the <br /> funds available under the PFA (PFA Funds) for the acquisition and installatio�i of TCDs, al] as shown in <br /> F,xhibit A-1 <br /> ABAG and Redwood City mutually agree as follows: <br /> l. Lnitial Allocation and Current I3alAnces. Redwood City has access [o $66, 009.00 (Sixty-six thousand <br /> and nine dollars) in PFA Funds to acquire and install TCDs. PFA Funds may only be used to <br /> fund or defray the costs of acquiring and/or instAllin6 TCDs from the panel of vendors listed iu Exhibit A-2 <br /> (see section 3). ABAG will calculate the amount of PFA I'unds to which Redwood City has access on any <br /> given day by reducing the initial allocation by the amount encumbered by TCDs on order (see section 3) a��d <br /> a�nounts paid for accepted TCDs. This information will be posted at <br /> http://w��vw.bavareatrashtracker.or�/contenUcontract-resources and will be adjusted on an as-needed basis. <br /> 2. Rea(locatians. <br /> (a) Redwood City acknowledges that the success of the Project depends on maximum use of the PF�1 Funds <br /> and that greater use may be achieved by reallocating access to PPA Punds among the Potential Participants <br /> that have executed an "Agreement i'or Local Agency Participation Grant Funded SF Bay Area'trasli Capture <br /> Deroonstration Project" by January 1, 20! 1(Pariicipating Entities). All reatlocations wiU be reflected in the <br /> current balance (see section 1). <br /> (b) All of the initial allacatioizs for any Potential Participants that have not executed an "Agreement for Local <br /> Agency Participation Grant Cunded SF Bay Area Trash Capture Demonstratiou ProjecY' by January 1, 201 ] <br /> � <br />
