01/24/2011 <br /> Exhibit B <br /> B. Findings Regarding Preparation and Consideration of the EIR <br /> The City Council finds, with respect to the City's preparation, review and <br /> consideration of the EIR, that: <br /> • The City exercised its independent judgment in accordance with <br /> Public Resources Code, section 20182.1(c), in retaining the independent <br /> consulting firm Wagstaff & Associates, Inc., to prepare the EIR, and <br /> Wagstaff & Associates, Inc., prepared the EIR under the supervision and <br /> at the direction of the City's Director of Planning Division. <br /> • The City circulated the Draft EIR for review by responsible and trustee <br /> agencies and the public and submitted it to the State Clearinghouse for <br /> review and comment by state agencies, as required by CEQA and the <br /> CEQA Guidelines. <br /> • The EIR and the proposed Downtown Precise Plan were presented to <br /> the City's Planning Commission, which reviewed and considered, and <br /> conducted a public hearing on, the EIR and proposed Downtown Precise <br /> Plan. The Planning Commission determined that the EIR was adequate <br /> and sufficient, and prepared in compliance with CEQA and the CEQA <br /> Guidelines, and recommended to the City Council that the City Council <br /> certify the EIR and approve the Project by adopting the proposed <br /> Downtown Precise Plan as a precise plan of the City. <br /> • The EIR and the proposed Downtown Precise Plan were presented to the <br /> City Council of the City, with the recommendation of the City's Planning <br /> Commission. The City Council reviewed and considered, and conducted a <br /> public hearing on, the EIR and proposed Downtown Precise Plan. <br /> • The EIR has been completed in compliance with CEQA and the CEQA <br /> Guidelines and reflects the City's independent judgment and analysis. <br /> By these Findings, the City Council ratifies, adopts and incorporates the analyses, <br /> explanations, findings, responses to comments, and conclusions of the EIR, except as <br /> otherwise specifically provided and described in these Findings. <br /> C. Findings Regarding Less Than Significant Impacts. <br /> By these Findings, the City Council ratifies and adopts the EIR's conclusions for the <br /> following potential environmental impacts which, based on the analyses in the EIR, this <br /> City Council determines to be less than significant: <br /> 4 Land Use and Planning <br /> Impact 4a.
