This credit adjustment will be made to the <br /> opening balance as part of the Fiscal Year 2009 -10 Compliance Auditor's report on Changes <br /> to the Balancing Account. <br /> 9. Fiscal Year 2007 -08 Now Closed. Neither the SFPUC nor any Suburban <br /> Purchaser may challenge the SFPUC's calculation of the Suburban Revenue Requirement for <br /> FY 2007 -08, as adjusted in accordance with this Agreement. The Suburban Representatives <br /> may seek injunctive relief to require the SFPUC to make any adjustment to the Balancing <br /> Account as of June 30, 2008 called for in this Agreement that has not already been made, as <br /> reflected in the Compliance Auditor's report on Changes in the Balancing Account as of June <br /> 30, 2009 issued in August 2010. <br /> 10. Complete Agreement. This Agreement represents the complete agreement <br /> among the parties with respect to FY 2007 -08. Attachments A through H are incorporated <br /> herein by this reference. <br /> 11. Counterparts.
