general conditions thus benefiting the general public and that no other reasonable <br />means of providing said modifications are available to the community and that the <br />aforesaid use to which the property is to be applied, i.e., for improvement of streets and <br />public highways, is a use authorized by law. <br />7. The City of Redwood City has complied with the environmental review <br />process under the provisions of CEQA and NEPA. <br />8. The adoption of a resolution of necessity is not a "project' under Public <br />Resources Code Section 15378 and such activity is exempt from CEQA requirements <br />under Public Resources Code Section 15061(b)(1). <br />9. The offer required by Section 7267.2 of the Government Code has been <br />made to the owner(s) of record. <br />10. The City Manager and /or the City Attorney and /or the Special Eminent <br />Domain Counsel, the Law Offices of Herman H. Fitzgerald, are authorized and directed <br />to perform all acts necessary on behalf of the City of Redwood City for the acquisition of <br />said interests in real property, and to do any and all other things in connection with such <br />proceedings as in his or their judgment may be necessary or convenient to the <br />successful conclusion of said proceeding or proceedings, including obtaining of an <br />Order for Immediate Possession, the preparation, filing, amendment, dismissal, etc., of <br />all pleadings and stipulations that in the opinion of Special Counsel are necessary for <br />the processing of the litigation. <br />11. The City Manager is hereby authorized to expend funds available to the City <br />for the acquisition of the real property. <br />12. The City Manager is hereby individually authorized and directed to consent <br />to and accept, on behalf of the City, all deeds and grants conveying any interest in the <br />property as hereinabove described. <br />13. The City Manager is hereby authorized and directed to record a certified <br />copy of this Resolution in the Office of the County Recorder of the County of San <br />F:Atty /Reso /Resol.1387 <br />Fitzgerald /040703 4 <br />14523 <br />
