6 -A-39 <br />Commissioner Radcliffe asked how the medical office parking will affect the Kaiser EIR. <br />Mr. Williams said Kaiser has done a parking analysis that would be justification for that <br />requirement. He did not think it was specifically based on the standards. <br />Michael Church, Planning Manager, said the proposal for Kaiser would be to develop a <br />precise plan that covers the entire campus. He said some separate standards will be <br />devised for them that will have nothing to do with the Zoning Ordinance provisions. <br />Commissioner Piulle, asked if they could take each Amendment and ask the pertinent <br />questions related to that specific Amendment, rather than jumping around. She said <br />sometimes you may forget the comments made by others. <br />ACTION <br />Amendment No. 1 — Construction of Arbors & Trellises in setback areas. <br />M /S: Garcia/Seybert - That the Zoning Ordinance is in the public interest and <br />recommend adoption. <br />Motion passed <br />DISCUSSION <br />Commissioner Piulle agrees with the Ordinance the way it is, with one big exception. <br />She does not agree with anything that is written about backyards. She said she <br />fundamentally opposes anything that will tell her what she can and can not do in her <br />backyard, as long as she does not interfere with her neighbors. She wants to strike the <br />section in the Ordinance relating to backyards. She thinks this is a part of an Ordinance <br />that is unenforceable. She said it really does not make any sense to have it there, <br />because the City does not have the time or the resources to go and police what people <br />are doing in their backyards. <br />Mr. Passanisi asked Commissioner Piulle for clarification as to whether she did or did <br />not want to allow trellises in the backyard? <br />Commissioner Piulle said she did not want any Ordinance to govern trellises or <br />structures in the backyard. <br />Commissioner Garcia said he would be willing to amend his motion, to take <br />Commissioner Piulle's comment into consideration. <br />Mr. Jany said that the current Ordinance does regulate what we can place in the back <br />yard. He said this proposal is much more permissive, and would allow an encroachment <br />very close to the property line, which is currently not allowed. Mr. Jany said what is <br />being proposed today is a relaxation of the current regulations, and actually a response <br />to a lot of cases that staff has reviewed. So this Ordinance is expected to respond to a <br />need by the public to construct these types of structures as proposed. So this proposal <br />is less restrictive. <br />Commissioner Seybert said he will not renew his second to the motion with the <br />Amendment. <br />Commissioner Garcia said since City staff put it the way they did, he would withdraw the <br />Amendment. <br />Page 17 of 26 <br />
