8• A " <br />The key provisions of the amendment include the following: <br />• Updated definitions of "child day care facility," "child day care center," <br />"child day care home," and "family child day care home" (small and <br />large) to provide consistency with State regulations and to distinguish <br />child day care from other kinds of day care (such as adult day care) <br />that are common today. <br />• A new Article 39 is proposed for Child Day Care Facilities, to outline <br />the basic criteria and review processes for child day care centers and <br />family child day care homes. These standards are relocated from the <br />present definitions, which should be limited to defining those terms. <br />• While most of the basic criteria and review processes remain the <br />same, provisions for "large family child day care homes" are revised <br />(new subsection 39.3(B)(7)) to delete requirements for public notice <br />and hearing for these homes (with 7 -12 children). Also, an existing <br />highly subjective provision requiring that the "facility shall be operated <br />in a manner which will not adversely affect adjoining residences and <br />not be detrimental to the health, safety and welfare of the <br />neighborhood" is proposed to be deleted. <br />• Specific provisions in the applicable residential and nonresidential <br />zoning districts, outlining permitted, accessory, and conditional uses, <br />are modified to reflect the revised terminology (usually adding the word <br />"child" and sometimes reference to Section 39.3). <br />Staff believes that these amendments respond to the need to provide for <br />child care facilities in the City, better align the Zoning Ordinance with State <br />law requirements for care facilities, and meets the intent of the original <br />City Council policy on child care facilities. These amendments clarify <br />definitions and uses allowed in each residential and nonresidential district, <br />and relocate the basic standards and review process provisions to a new <br />Article 39. The discretionary review and public hearing process for large <br />family child day care homes would be replaced by a ministerial review <br />process subject to complying with the standards of Section 39.3. <br />GENERAL PLAN CONFORMANCE <br />The proposed Zoning Ordinance amendments are consistent with General Plan <br />land uses and policies. All of the proposed changes allow uses that are already <br />permitted by the General Plan. Revisions instead provide for clarification and <br />specification regarding what types of uses are allowed, and the standards that <br />guide their development. <br />In addition, the theater use for downtown has been addressed in the <br />Environmental Impact Report for the Downtown Cinema Project, and has been <br />determined to be consistent with current General Plan land use designations. <br />0 <br />
