<br />AB 1141 (Diaz). Meyers - Milias -Brown Act.
<br />Agency Shop Agreements. AB 1141 amends
<br />the local agency collective bargaining law, known
<br />as the "Meyers- Milias -Brown Act" (MMBA) to
<br />extend agency shop agreements to confidential
<br />and supervisory employees. The MMBA, unlike
<br />most employment law including those affecting
<br />most of the other public employees in this state,
<br />generally permits management and confidential
<br />employees to join represented units of employees
<br />and to participate in the collective bargaining
<br />process. This creates a built -in conflict of interest
<br />for management and confidential employees that
<br />does not exist in other labor laws. The MMBA
<br />provides for agency shop agreements that can be
<br />imposed without the agreement of the local
<br />agency and would generally require union mem-
<br />bership or alternative dues payment from all
<br />members of a bargaining unit. In recognition of
<br />the conflict between forced participation of man-
<br />agement and confidential employees in employee
<br />groups, they have been exempted from the
<br />agency shop provisions of MMBA. Staff: Amy
