& A -H <br />Legislative Bill Action <br />................................ ............................... <br />quires a magistrate, when presented with an affidavit <br />from a peace officer establishing reasonable cause to <br />believe that a vehicle is being operated as a for hire <br />taxicab or passenger vehicle in violation of local <br />licensing requirements, to issue a warrant or autho- <br />rize the peace officer to seize the vehicle in question. <br />It also requires that the vehicle be impounded for a <br />period up to 30 days, with the impounding agency <br />notifying, within two working days, the legal owner of <br />the vehicle. Additionally, AS 299 was amended to <br />prohibit a charter -party carrier of passengers from <br />advertising or otherwise representing their services to <br />the public, as a taxicab or taxi service. The City of Los <br />Angeles is the sponsor of the bill. Staff: Natasha <br />Fooman; Status: SenTrans, Hrg. 7/1, Position: <br />Support. <br />AB 327 (Runner). Vehicles. Parking. Per- <br />sons with Disabilities. Violations. AS 327 in- <br />creases the penalty for violating statues related to <br />disabled persons parking privileges. AS 327 raises <br />from $250 to $500 the minimum fine for the improper <br />use of disabled persons distinguished license plates <br />or placards. It also raises from $250 to $500 the <br />minimum fine for illegally parking in a stall or space <br />designated for disabled persons and disabled veter- <br />ans. The author points out that current punishment <br />for abusing disabled placards were established in <br />1992 and are increasingly failing to serve as an <br />effective deterrent. Assembly Member Runner <br />believes that the low minimum fines encourage <br />people to take their chances when faced with other- <br />wise limited parking opportunities. Therefore raising <br />the minimum fine will serve as a deterrent as well as <br />raise local revenues. SB 966 permits a contractor to recover <br />increased costs from an awarding body of public <br />works, if the work has been determined to be subject <br />to prevailing wages after the job has begun. Existing <br />law requires the payment of prevailing wages to <br />workers employed by private contractors on public <br />works projects valued at $1,000 or more. The <br />awarding body must obtain the applicable prevailing <br />rates from the Department of Industrial Relations <br />(DIR). It is not always clear at the time of negotiation <br />or bidding of the project whether the specific project <br />will be covered by prevailing wage laws. If the project <br />is a public work as determined by DIR, then the <br />contractor performing the work is obligated to pay <br />prevailing wages. The League has been working with <br />the author's office and EBMUD on amendments to <br />this bill. Capital Facilities Fees. <br />AB 1051 would clarify existing law regarding how <br />public municipal utilities charge other public agencies <br />for capital facilities fees. This bill is in response to <br />numerous lawsuits filed by schools and other public <br />agencies regarding utility fees. Cities that have <br />municipal water, sewer, gas or electric utilities should <br />take a close look at AB 1051 which is co- sponsored <br />by the City of San Francisco, the City of Los Angeles <br />and the East Bay Municipal Utility District. The bill was <br />approved by the Senate Local Government Commit- <br />tee this week, and will be heard next in the Senate <br />Education Committee. Staff: Yvonne Hunter; Status: <br />SenEd, Position: Support. <br />SJR 7 (Karnette). Highways. Trucking Size. <br />SJR 7 passed out the Senate on 5/22 by a vote of 22- <br />11. SJR 7 memorializes the President and the Con- <br />gress of the United States to maintain the current <br />federal truck size and weight limitations and to oppose <br />proposals to experiment with longer and heavier <br />trucks on public highways in the reauthorization of the <br />federal Transportation Equity Act for the 21 ` Century <br />(Public Law 105 -178). Staff: Natasha Fooman; <br />Status: AsTrans, Hrg. 6/23. Position: Support <br />SB 966 (Alarcon). Contractor's Costs. SB <br />966 passed out of the Senate on May 8, 2003 by a <br />SB 20 (Sher). Electronic Waste. SB 20 would <br />establish a manufacturer responsibility program for <br />the collection and recycling of electronic waste. It <br />would prohibit any person from selling certain elec- <br />tronic devices, designated as hazardous, in California <br />unless they either develop and implement a program <br />to provide convenient recycling opportunities for their <br />products, or they could pay a fee in lieu of such a <br />program to be used to support grants to local govern- <br />ments.
