reason of not carrying out said agreement or agreements or <br />performing said obligation or obligations during the continuance of <br />such inability. The Participating Owner shall make a reasonable <br />effort to remedy with all reasonable dispatch the cause or causes <br />preventing it from carrying out its agreements; provided, that the <br />settlement of strikes, lockouts and other industrial disturbances <br />shall be entirely within the discretion of the Participating Owner; <br />and the Participating Owner shall not be required to make <br />settlement of strikes, lockouts and other industrial disturbances <br />by acceding to the demands of the opposing party or parties when <br />such course is in the judgment of the Participating Owner <br />unfavorable to the Participating Owner. <br />C. The completion and operation of the Project by the <br />Participating Owner will substantially assist the Agency to <br />implement the Redevelopment Plan. Therefore, the Participating <br />Owner will complete the Project by June 30, 2004. The Agency has <br />relied upon the Participating Owner's representations in that <br />regard in determining the scope of the Agency Assistance that would <br />be warranted under the circumstances to encourage the <br />rehabilitation of the Property. <br />d. For the purposes hereof, completion of the Project <br />shall mean the date on which the Agency executes the Certificate of <br />Completion, as provided in Section 18 hereof, provided that such <br />execution shall not be unreasonably withheld, conditioned or <br />delayed. <br />Section 8. Insurance. Prior to the commencement of <br />construction on any portion of the Property, the Participating <br />Owner shall furnish, or shall cause to be furnished, to the Agency <br />duplicate originals or appropriate certificates of public indemnity <br />and liability insurance in the amount of One Million Dollars <br />($1,000,000.00) combined single limit, naming the Agency and the <br />City as additional insureds. Said insurance shall cover <br />comprehensive general liability including, but not limited to, <br />contractual liability; acts of subcontractors; premises- operations; <br />explosion, collapse and underground hazards, if applicable; broad <br />form property damage, and personal injury including libel, slander <br />and false arrest. In addition, the Participating Owner shall <br />provide to the Agency adequate proof of comprehensive automobile <br />liability insurance covering owned, non -owned and hired vehicles, <br />combined single limit in the amount of One Million Dollars <br />($1,000,000.00) each occurrence; and proof of workers' compensation <br />insurance. Any and all insurance policies required hereunder shall <br />be obtained from insurance companies admitted in the State of <br />California and rated at least B +: XII in Best's Insurance Guide. <br />All said insurance policies shall provide that they may not be <br />canceled unless the Agency and the City receive written notice of <br />7 <br />
