8.A ATTACh�f� RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL �F THE CITY OF REDWOOD CITY DECLARING ITS CONSIDERATION OF AMENDING CERTAIN PROVISIONS RELATtNG TO COMMUNITY FACILITIES DISTRICT NO 2010-1 (ONE MARINA) WHEREAS, under the provisions of the Meilo-Roos Community Facilities Act of 1982, constituting Section 53311 et seq. of the California Govemment Code (the "Law"), this City Council has previously formed a community facilities district under the Law known as the City of Redwood City Community Facilities District No. 2010-1 {One Marina) (the "District"); and WHEREAS, there has been submitted to this City Council a Petition and Waiver (the "Petition") from R.C. Peninsula Park, L�C, a Delaware limited liability company (the "Petitioner"), requesting that the City Council undertake proceedings under the Law to (a) amend the Rate and Method of Apportionment of Special Tax (the "RMA") as approved by the City Council by Resolutian No. 15048 adopted on August 9, 2010 (the "Resolution of Intention"), (b) to amend the description af the facilities eligible for funding by the CFD (the "Facilities°) as set forth in Exhibit B af the Resolution of Intention, so as to remove the payment of certain impact and school fees previously authorized, as set forth in Exhibit B hereto; (cj to reduce fhe authorized special tax bonds and appropriations limit for the CFD to an amount not to exceed $7,500,000; and (d) to authorize the removaf of certain prope�ty exempt from taxation under the RMA from the CFD upon the filing of a final map, as set forth in the Boundary Map attached hereto as Exhibit A; and WHEREAS, under the Law, this City Council is the legislative body for the District and is empowered with the authority to make such changes with respect to the District; and WHEREAS, this Gity Council now desires to proceed with the actions necessary ta consider the amendment of the District. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redwood City (the "City") as follows: Section 1. This City Council hereby considers the proceedings necessary to certain amend provisions relating to the District pursuant to the Law. Receipt of the Petition requesting such changes is hereby acknowledged. The City Council hereby determines that the proposed changes to the District comply with the City's Staternent of Goals and Policies adopted pursuant to the Law (the "CFD Goals"). Section 2. The current boundaries of the District, and the proposed deletion of the hotel site (which is proposed to be exempt from taxation under the RMA) from the CFD upon the filing of a final map are as shown on the map of the District on fiie with the City Clerk and attached hereto as Exhibit A, which revised boundaries are hereby approved. This City Council cfir�cts the City Clerk to certify the adc�ption of this resolution on the face of the map, and the City Clerk is hereby directed to record, or cause to be recorded, the map of the boundariss of the District in the office of the County Recorder of the County of San Mateo {the "County"� as soon as practicable after the adoption of this Resolution.
