• <br /> 03/21/2011 <br /> ORIGINAL <br /> RESOLUTION NO 15102 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br /> DECLARING ITS CONSIDERATION OF AMENDING CERTAIN PROVISIONS <br /> RELATING TO COMMUNITY FACILITIES DISTRICT NO 2010 -1 (ONE <br /> MARINA) <br /> WHEREAS, under the provisions of the Mello -Roos Community Facilities Act of 1982, <br /> constituting Section 53311 et seq. of the California Government Code (the "Law "), this City <br /> Council has previously formed a community facilities district under the Law known as the City of <br /> Redwood City Community Facilities District No. 2010 -1 (One Marina) (the "District "); and <br /> WHEREAS, there has been submitted to this City Council a Petition and Waiver (the <br /> "Petition ") from R.C. Peninsula Park, LLC, a Delaware limited liability company (the <br /> "Petitioner"), requesting that the City Council undertake proceedings under the Law to (a) <br /> amend the Rate and Method of Apportionment of Special Tax (the "RMA ") as approved by the <br /> City Council by Resolution No. 15048 adopted on August 9, 2010 (the "Resolution of Intention "), <br /> (b) to amend the description of the facilities eligible for funding by the CFD (the "Facilities ") as <br /> set forth in Exhibit B of the Resolution of Intention, so as to remove the payment of certain <br /> impact and school fees previously authorized, as set forth in Exhibit B hereto; (c) to reduce the <br /> authorized special tax bonds and appropriations limit for the CFD to an amount not to exceed <br /> $7,500,000; and (d) to authorize the removal of certain property exempt from taxation under the <br /> RMA from the CFD upon the filing of a final map, as set forth in the Boundary Map attached <br /> hereto as Exhibit A; and <br /> WHEREAS, under the Law, this City Council is the legislative body for the District and is <br /> empowered with the authority to make such changes with respect to the District; and <br /> WHEREAS, this City Council now desires to proceed with the actions necessary to <br /> consider the amendment of the District. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redwood City <br /> (the "City ") as follows: <br /> Section 1. This City Council hereby considers the proceedings necessary to certain <br /> amend provisions relating to the District pursuant to the Law. Receipt of the Petition requesting <br /> such changes is hereby acknowledged. The City Council hereby determines that the proposed <br /> changes to the District comply with the City's Statement of Goals and Policies adopted pursuant <br /> to the Law (the "CFD Goals "). <br /> Section 2. The current boundaries of the District, and the proposed deletion of the <br /> hotel site (which is proposed to be exempt from taxation under the RMA) from the CFD upon <br /> the filing of a final map are as shown on the map of the District on file with the City Clerk and <br /> attached hereto as Exhibit A, which revised boundaries are hereby approved. This City Council <br /> directs the City Clerk to certify the adoption of this resolution on the face of the map, and the <br /> City Clerk is hereby directed to record, or cause to be recorded, the map of the boundaries of <br /> the District in the office of the County Recorder of the County of San Mateo (the "County ") as <br /> soon as practicable after the adoption of this Resolution. <br /> ATTY /RESO.2110 /OF CONSIDERATION ATTCH1 & EXHIBIT B ONE MARINA Reso. # 15102 <br /> 030411 MUFF # 506 <br /> 1 <br />
