• <br /> "Future Excluded Property" means all property located within Lot 1 as depicted for both hotel <br /> and retail uses on One Marina Vesting Tentative Map approved by Redwood City Planning <br /> Commission on July 20, 2010. <br /> "Indenture" means the indenture, fiscal agent agreement, resolution or other instrument <br /> pursuant to which CFD No. 2010 -1 Bonds are issued, as modified, amended and/or <br /> supplemented from time to time. <br /> "Land Use Class" means any of the classes listed in Table 1 and Table 2, below. <br /> "Location" means Marina View Property or Non - Marina View Property as defined in this <br /> Section A. <br /> "Marina Property" means all property located within Lot 4 as depicted for existing preserved <br /> marina basin on One Marina Vesting Tentative Map approved by Redwood City Planning <br /> g p pp Y Y g <br /> Commission on July 20, 2010. <br /> "Marina View Property" means all Residential Property that have (i) front, rear, or side yard <br /> frontage along the Marina Property, or (ii) direct front door access to the Marina Property. <br /> "Maximum Special Tax" means the maximum Special Tax, determined in accordance with <br /> Section C herein, that can be levied in any Fiscal Year on any Assessor's Parcel of Taxable <br /> Property. <br /> "Non Marina View Property" means all Residential Property that is not Marina View <br /> Property. <br /> "Non Residential Property" means all Assessor's Parcels of Developed Property for which a <br /> building permit permitting the construction of one or more non - residential units or facilities has <br /> been issued by the City. <br /> "One Time Special Tax" means a one -time special tax to be levied by the CFD Administrator <br /> on Public Property or Property Owner Association Property that is not exempted from the <br /> Special Tax under Section F herein, and is therefore required to prepay such Special Tax under <br /> Section F. The one -time special tax shall be equal to the Special Tax Prepayment Amount <br /> necessary to mitigate the loss of special tax revenues from such excess Public Property or <br /> Property Owner Association Property, as calculated under Section J.3 herein. <br /> "Outstanding Bonds" means all CFD No. 2010 -1 Bonds which are deemed to be outstanding <br /> under the Indenture. <br /> "Property Owner Association Property" means, for each Fiscal Year, (i) any property within <br /> the boundaries of CFD No. 2010 -1 for which the owner of record, as determined from the <br /> County Assessor's secured tax roll for the Fiscal Year in which the Special Tax is being levied, <br /> is a property owner's association, including any master or sub - association, (ii) any property <br /> located in a Final Subdivision that was recorded as of the January 1 preceding the Fiscal Year in <br /> which the Special Tax is being levied and which, as determined from such Final Subdivision, is <br /> or will be open space, a common area recreation facility, or a private street, or (iii) any property <br /> Community Facilities District No. 2010 -1 February 16, 2011 <br /> City of Redwood City (One Marina) Page 4 <br />
