Sales and Use Tax. SB 103 <br />provides clarification to which retail businesses <br />must collect sales and use tax on purchases <br />made in California. If a retailer offers services or <br />repairs on its goods by staff or contractors located <br />in California, the retailer is considered to have a <br />retail presence in California. Processing of orders <br />by electronic means from a location outside of <br />California does not exclude a retailer from the <br />obligation to collect taxes if the retailer is otherwise <br />engaged in business activities in the state. The <br />retailer that has directly or through a subsidiary a <br />substantial interest in a California retailer and sells <br />the same lines of goods under a similar retail <br />name in California will be deemed to be in busi- <br />ness in California for the purposes of collecting <br />sales and use tax. SB 103 failed to secure a <br />majority vote when it was heard on June 30 in the <br />Assembly Jobs, Economic Development and the <br />Economy Committee. Reconsideration before the <br />committee was rescheduled.
