WWW.REDWOODCITYPORT.COM _ ISSUED ARIL 13, 2011 , Effective: May 1, 2011 SECTION II — RATES FOR BERTHING, STORAGE AND SERVICES PAYMENT OF CHARGES ( ITEM No. 21 1. Charges for berthing and storage space are due and payable monthly in advance. 2. Charges that are not paid within ten (10) days from the date of invoice will be considered past due and delinquent. 3. Berthing permit holders with delinquent charges will be subject to a 3 day notice to pay or quit. At the Port's option, the Port may then require that the permit holder post a deposit. The "delinquency deposit" is equal to the last three months' charges and shall be due and payable within ten (10) days of notice. Nonpayment of the "delinquency deposit" within 10 days specified shall be cause for termination of the permit. 4. Berthing permit holders who have been required to post a delinquency deposit for delinquent charges will be refunded such delinquency deposit (without interest) after maintaining their account in good standing for a twelve (12) consecutive month period. An account maintained in good standing shall be an account which has not recorded a past due balance for any month within the above referred twelve (12) consecutive month period. 5. Permit holders who become delinquent more than once, within the above referred twelve (12) consecutive month period, thereby requiring the Port to draw on the delinquency deposit, will be requested to vacate the berth. (*) NOTE: The delinquency deposit requirements shall be in addition to any security deposit required (Item 21). Delinquency deposits shall be used solely for the purpose of curing default of monthly berthing and storage charges. Nothing herein provided shall require the Port to maintain delinquency deposits, or any of them, in a separate or special fund. No interest on the delinquency deposit shall accrue to the benefit of any permit holder.
