lease, permit, license, certificate, or other entitlement for <br /> use involved with the proposed project. <br /> (b) Fee for Preparation of Environmental Impact Report. For <br /> all projects which require the preparation of an environmental <br /> impact report an applicant shall pay a nonrefundable fee in an <br /> amount equal to the sum of $ 100 times the number of acres of land, <br /> or any portion thereof, to which the proposed project applies. <br /> One-half of the fee paid pursuant to the provisions of subparagraph <br /> (a) above shall be credited to the total amount payable under this <br /> subparagraph. The fee to be paid under this subparagraph shall <br /> be paid upon notification by the Planning Director to the applicant <br /> that the proposed project requires the preparation of an environ- <br /> mental impact report. <br /> (c) Fee for Preparation by Consultant. In the event an <br /> environmental impact report is to be prepared by a consultant <br /> pursuant to the provisions of paragraph 7 (c) (3) below, the <br /> applicant shall pay to the City the total estimated sum for the <br /> preparation of such report prior to the award of the agreement <br /> by the City to the consultant. In the event the actual amount <br /> to be paid by the City pursuant to such agreement exceeds the sum <br /> so deposited, the applicant shall pay the difference upon notifi- <br /> cation thereof by the City, and in the event said final amount is <br /> less than the amount so deposited, the City shall remit to the <br /> applicant the difference between the actual amount and the amount <br /> deposited upon completion of the environmental impact report by <br /> the consultant. No part of the fee to be paid pursuant to the <br /> provisions of subparagraph (a) above shall be credited to any <br /> sums to be deposited or paid pursuant to this subparagraph, and <br /> the entire fee paid pursuant to subparagraph (a) above shall be <br /> retained by the City. <br /> -8- <br />
