Section 65. Borrowina Monev by the Citv <br />This section allows the City to issue and sell bonds. However, the payment period for any <br />bond issued and sold is limited to a term of years not to exceed the estimated period of <br />usefulness of the property or imprcvement for which they are issued or twenty (20) years. <br />This section was adopted in 1929 and has never been amended. As the marketplace for <br />the issuance and sale of bonds has changed dramatically since 1929, and in order to <br />maximize the flexibility for the payment of any bonds issued and sold, it is proposed that <br />the maximum payment period be extended to thirty (30) years. The proposed amendment <br />to section 65 is attached hereto as Exhibit "C." <br />Section 67. Contracts <br />This section requires that any proposed public work or improvement valued between Ten <br />Thousand Dollars ($10,000) and Twenty Thousand Dollars ($20,000) be awarded to the <br />lowest responsible bidder without public advertisement; but that for such work or <br />improvement in excess of Twenty Thousand Dollars ($20,000), said work is to be awarded <br />to the lowest responsible bidder with public advertisement. This section was last amended <br />in 1982. As the construction industry is reluctant to invest time and resources into <br />preparing and submitting bid documents for public works or improvement projects with <br />relatively low values, it is proposed that all public works or improvements projects of less <br />than One Hundred Thousand Dollars ($100,000) be awarded to the lowest responsible <br />bidder without public advertisement; and that public works or improvement projects in <br />excess of One Hundred Thousand Dollars ($100,000), be awarded to the lowest <br />responsible bidder with public advertisement. The proposed amendment to section 67 is <br />attached hereto as Exhibit "D." <br />Section 88. Claims Aaainst Citv <br />This section regulates the manner in which claims for money or damages are brought <br />against the City, relevant time periods for filing and rejecting any claim, the processing of <br />claims, and the types of actions for which a claim need not be filed. This section was last <br />amended in 1954. The State of California has enacted the Government Tort Claims Act <br />which comprehensively establishes the manner in which claims for money or damages <br />against local public entities are to be handled. As this section does not reflect current <br />State law, it is proposed that this section be deleted in its entirety. Any discretion the City <br />may be permitted to exercise with respect to claims for money or damages, may be <br />performed by locally enacted ordinance. Section 88 is attached hereto as Exhibit "E." <br />Section 90. Official Advertisina <br />This section requires the City Council to annually seek bids for its official advertising and <br />award a contract to the lowest responsible bidder. The lowest responsible bidder must be <br />a newspaper of general circulation in the City of Redwood City. This section was enacted <br />in 1929 and has consistently proven to be burdensome. A survey of the selection process <br />utilized by other municipalities in San Mateo County has revealed that a bid process is not <br />the method of choice. It is proposed that this section be deleted in its entirety and <br />thereafter, the City Council may determine the best means for contracting for publication of <br />official advertising.
