(0-18-1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />July 21, 2003 <br />Subject <br />Assignment and Assumption Agreements for Curtis Williams /MHA Environmental <br />Consulting, Inc. <br />Recommendation <br />Approve the Attached Assignment and Assumption Agreements <br />Background <br />The City currently has two professional service agreements with Curtis Williams and <br />Associates. Each was approved by the City Council. Mr. Williams has a contract to <br />process the Marina Shores Village project, and also to work on planning tasks such as <br />amending the Zoning Ordinance and processing specific project applications (e.g. the gas <br />station at WhippleNeterans). <br />Mr. Williams recently joined an environmental planning firm, MHA Environmental <br />Consulting, Inc. Because his previous agreements are with his previous firm it will be <br />necessary to amend the agreements and assign all his rights and obligations to his new <br />firm. For this reason the City Council needs to approve the attached two Assignment and <br />Assumption Agreements. <br />Alternative <br />Not approve the amendments and thereby terminate the contracts. <br />Fiscal Impact <br />There will be no fiscal impact to the City as the term and costs of the projects do not <br />change by this action.
