<br />AB 1263 (Benoit). Trespass. AB 1263 makes
<br />knowing entry or re-entry into a sterile area of an
<br />airport after intentionally avoiding submission to
<br />the screening and inspection of one's person and
<br />accessible property in accordance with the
<br />procedures being applied to control access to that
<br />area. AB 1263 would make trespassing punish-
<br />able as a misdemeanor with imprisonment of not
<br />more than six months in a county jail unless a
<br />violation is responsible for the evacuation of an
<br />airport terminal, is responsible in any part for
<br />delays or cancellations of scheduled flights, and
<br />the sterile area is posted with reasonable notice
<br />that the trespass may be prosecuted, in which
<br />case it would be punishable as a misdemeanor
<br />with not more than one year imprisonment in a
<br />county jail. The League supports AB 1263 be-
<br />cause it seeks to give local law enforcement the
<br />discretion to charge individuals who breech
<br />security checkpoints at airports with a felony
<br />when trespass results in flight delays and cancel-

<br />AB 1277 (Cohn). High Technology Crime,
<br />AB 1277 would add music and video piracy, and
<br />the unlawful duplication of audio recordings and
<br />audiovisual works to those within the High Tech-
<br />nology Theft Apprehension Prosecution Program
<br />(HTTAPP). The piracy of music in California has
<br />grown significantly in recent years and is a threat
<br />to the economic base of one of California's

<br />SB 762 (Brulte). Nonviolent drug posses-
<br />sion offense. Personal use. SB 762 clarifies
<br />the definition of "nonviolent drug possession
<br />offense" by providing that the term means the
<br />unlawful personal use, possession for personal
<br />use, or transportation for personal use of any
<br />controlled substance classified in Schedules I to
<br />V. Current law generally provides that, effective
<br />July 1, 2001, (a) a person convicted of a nonvio-
<br />lent drug possession offense shall receive proba-
<br />tion with completion of a drug treatment program
<br />as a condition of that probation, and (b) a person's
<br />parole may not be suspended or revoked for
<br />committing a nonviolent drug possession offense
<br />or for violating a drug - related condition of parole,
<br />but an additional condition of parole for those
<br />offenses or violations shall be the completion of a
<br />drug treatment program. Existing law defines the
<br />term "nonviolent drug possession offense" to
<br />mean the unlawful possession, use, or transporta-
<br />tion for personal use of any controlled substance
<br />classified in Schedules I to V, inclusive. SB 762
<br />further clarifies the intent of Proposition 136. SB
