Legislative Bill Action
................................ ...............................
AB 1263 (Benoit). Trespass. AB 1263 makes
knowing entry or re-entry into a sterile area of an
airport after intentionally avoiding submission to
the screening and inspection of one's person and
accessible property in accordance with the
procedures being applied to control access to that
area. AB 1263 would make trespassing punish-
able as a misdemeanor with imprisonment of not
more than six months in a county jail unless a
violation is responsible for the evacuation of an
airport terminal, is responsible in any part for
delays or cancellations of scheduled flights, and
the sterile area is posted with reasonable notice
that the trespass may be prosecuted, in which
case it would be punishable as a misdemeanor
with not more than one year imprisonment in a
county jail. The League supports AB 1263 be-
cause it seeks to give local law enforcement the
discretion to charge individuals who breech
security checkpoints at airports with a felony
when trespass results in flight delays and cancel-
lations. High Technology Crime,
AB 1277 would add music and video piracy, and
the unlawful duplication of audio recordings and
audiovisual works to those within the High Tech-
nology Theft Apprehension Prosecution Program
(HTTAPP). The piracy of music in California has
grown significantly in recent years and is a threat
to the economic base of one of California's
strongest industries. SB 762 clarifies
the definition of "nonviolent drug possession
offense" by providing that the term means the
unlawful personal use, possession for personal
use, or transportation for personal use of any
controlled substance classified in Schedules I to
V. Current law generally provides that, effective
July 1, 2001, (a) a person convicted of a nonvio-
lent drug possession offense shall receive proba-
tion with completion of a drug treatment program
as a condition of that probation, and (b) a person's
parole may not be suspended or revoked for
committing a nonviolent drug possession offense
or for violating a drug - related condition of parole,
but an additional condition of parole for those
offenses or violations shall be the completion of a
drug treatment program. Existing law defines the
term "nonviolent drug possession offense" to
mean the unlawful possession, use, or transporta-
tion for personal use of any controlled substance
classified in Schedules I to V, inclusive. SB 762
further clarifies the intent of Proposition 136. SB
762 passed out of Assembly Public Safety Com-
mittee on July 8, 2003.
