REPORT <br /> To the Honorable Mayor and City Council <br /> <br />April ~, 2002 <br /> <br />Subject <br />Consultant Agreement for Engineering Consulting Services for the BCDC Public Access <br />Mitigation as related to the Levee Rehabilitation Project - Engineering File No. 803-02 <br /> <br />Recommendation <br />Approve and authorize an agreement with BKF Engineers, of Redwood City, California,' <br />for providing Consulting Engineering Services for the BCDC Public Access Mitigation as <br />related to the Levee Rehabilitation Project, in an amount not to exceed $15,000. <br /> <br />Background <br />The BCDC permit for the levee rehabilitation project has many mitigation measures <br />associated with it. The biggest mitigation is the construction of the alternate inland <br />public access bicycle and pedestrian paths. Along with this path, BCDC also requires <br />that the Public Access Restriction (easement) to these paths somehow be dedicated in <br />perpetuity. For this reason, the legal descriptions for these paths must be established in <br />order for the facility to be dedicated. <br /> <br />On June 7, 2001, BCDC issued a Stipulated Cease and Desist Order to the City of <br />Redwood City, because some of the mitigation has not been constructed. The Order <br />also required that the instrument of conveyance of the interest in the paths be submitted <br />to BCDC for review, and gave the City 20 days to complete this instrument. Since BKF <br />worked on the design of many of these paths for Ryland (who is a co-permittee), and <br />time was of the essence, BKF was retained by staff to draft the conveyance instrument. <br /> <br />When this effort began, both the consultant and Staff did not think that it would take <br />many resources; therefore, this could be covered under dir. ect payment. However, as <br />work progressed, it was found that the area to be covered was *widespread; <br />consequently, it was taking much more time to complete. Work could not be stopped <br />because of the deadline. The instrument was finally completed and submitted to BCDC <br />for comments on July 6, 2001. <br /> <br />Thus far, the Consultant has spent a total of $8,255.44. BCDC has not approved nor <br />reviewed the instrument; therefore, only an estimate can be made as to what more <br />needs to be done to satisfy BCDC requirements. This contract makes an allowance of <br />$6,744.56 for the effort, for a total amount of $15,000. Any unused allowance will be <br />liquidated, and if the allowance is insufficient, a Task Order will be processed. <br /> <br />A complete copy of the agreement is available for review in the City Clerk's office. <br /> <br /> -1- <br /> <br /> <br />
