REPORT <br /> <br /> To the Honorable Mayor and City Council · <br /> From the City Manager <br /> <br />April 8, 2002 <br /> <br />Subject <br />Rescission of Resolution 14277, Photo Red Light Enforcement System. <br /> <br />Recommendation <br />Council rescind Resolution 14277, which approved and authorized execution of an agreement for the <br />installation of a Photo Red Light Enforcement System by Lockheed Martin IMS. <br /> <br />Background. <br />On July 9, 2001, Council adopted a resolution approving and authorizing execution of an agreement <br />for the installation of a Photo Red Light Enforcement System by Lockheed Martin IMS. Since then, <br />several issues have arisen that cause the police department to recommend to Council to discontinue <br />the project and rescind the resolution. <br /> <br />In September, 2001, a judge in San Diego County dismissed hundreds Of traffic citations, which were <br />issued using the same vendor and system being proposed in Redwood City. There are currently <br />several other court cases pending alleging violation of constitutional rights by the system. Until a <br />court decision is made regarding the system's reliability and constitutionality, Redwood City would <br />likely be the target of similar litigation. <br /> <br />While red light violations continue to pose problems in many municipalities, further review of traffic <br />collisions in Redwood City reveal that red light violations account for fewer than five percent of all <br />collisions over the past two years. Given recent developments, pressing forward with a photo <br />enforcement system might strengthen arguments that Redwood City is pursuing the system for <br />strictly monetary gain. <br /> <br />Fiscal Impact <br />None.
